I thought it was but a chap here (who in all fairness is pretty knowledgeable) is adamant? Need some evidence to back my case!!
Simple to prove.
Imagine a constituency with around 62,000 electors.
Sitting MP is a Labour member with a majority of 13,000.
He dies and there is a by election which has a fairly typical 42% turnout. Your man's theory would see all of those uncast ballots counting for the labour candidate.
58% of 62,000 is 35960 or enough to beat every vote actually cast.
In actual fact the example is Glasgow East and the SNP overturned that majority to take the seat but still only commanded 43% of the 26219 votes cast
