Default Compensation for whiplash??

Just wondered if this sort of thing was still possible. Just had someone shunt me up the arse in the girlfriends car ( ) and my neck is hurtin, headache too

Yep, go to A&E asap and get it logged and diagnosed. Then if it stills gives you greif after a few weeks, go to see your GP for a further check up just to be sure.

Youll have to go to A&E within 24hrs of the accident really as thats when whiplash takes effect.

Why do you want compensation? Are you suffering from loss of earnings? Is there a real reason or do you just want to scam the system and put everyones insurances prices up

as above, you need a record of all the appointmetns/treatments etc. i got knocked of the bike a few months ago, got the bike paid for and got to keep the bike! The payment for the damage to self will take longer aparently but it will come. Its all good.

EDIT - i dont think the whiplash comes within 24 hrs, well its close, each time i got it it hurt like hell the day after.......spose that is 24 hrs..........?

The reason im seriously considering this is because she was sat there texting on her phone, i had 2 cars in front of me, the lights went green but i wasnt able to move until the cars infront moved (obvio), she was too busy on her phone saw green and shunted me up the rear end whilst i was still stationery, and luckily i had my foot on the brake so i didnt hit the car infront!

cutch, yeah thats what i meant mate so i assume you would be ok to go after 24hrs so maybe 48 hrs from the accident really.

Ive had it before and it hurt like hell the morning after, around 15 hrs from the accident. Didnt hardly hurt at all at the time of the accident but gradually became stiffer and aching hour by hour, then was bloody killing in the morning.

It all depends on how much you give out about it to the injury soliciotrs. If you make a meal of it you will get more. If you just say my neck hurts and it hasnt affected your day to day life you wont get a lot

It wont affect her whether you claim for whip lash or not though mate. A claim is a claim so i assume there paying out for the car anyway so will just go down as one claim by the insurance company.

If it hurts, then claim. Thats what insurance is for. If you dont claim, then you may regret it later on as the pain may come back to haunt you a few years down the line. My neck often gives me jip from a previous accident years ago.

i got whiplash and a damaged bone in my back (chipped edge) and got paid just over £9000, i was well chuffed. as for "a +e within 24 hours its rubbish, i went a week after and they said its quite common to get delayed whiplash

Whiplash can take anything from 10 minutes to 1 week to start, depends on so many factors.
I have been rear ended 5 times in 11 years or so, and once by the "feds".
Average has been £4500, Roosie off here does this now accident claims so why not give him a call on 07850 671020, STUART WINDOW is his name.
I even had one claim where I had to take the GOVERNMENT to COUNTY COURT, and won litigation costs werte crippling, costs £11K to get it done, but got it all back.
Don't be put off by morons who say putting up people insurance by claiming, a claim exists because someone ELSE is at FAULT, ie the stupid cow texting/phoning.
I see it this way we all pay, so why should we NOT be compensated for injuries that happen.
Whiplash can and often does leave PERMANENT effects, my neck physically jams sometimes.
Don't be in a hurry for settlement, every specialist including SPINAL specialist say it can take UP TO two YEARS to get as bad as it is going to before healing starts, so be assesd at it's worst.

i recently got £3,300 from the Criminal Injuries compensation authority

took 2 years to get but i didnt mind waiting.

I Broke a fight up between 2 lasses on a night out (i didnt know the girls but regardless i dont like to see them fighting) as i was splitting them up, some knob comes running over (i didnt see him) smacks me, i go down and ended up breaking my wrist....he got done by cops etc i prsued a claim, £3,300 was a very nice result i thought.

and now when i see people fighting and killing each other, i let them get on with it.

i got 2.5k for whiplash in 1997, car went into the back of car behind me at 30mph he was blinded by the sun apparently, i had a neck support thing on for about a week and was fine after that didnt have any lasting problems

I think the issue here is people claiming when they DON'T have an injury. I've no idea about the specifics of Safechav's case, but bogus claimers, and ambulance chasers really piss me off.

I was in an accident in a mate's car. He claimed, and when I didn't his insurers badgered me for months trying to get me to claim too.

safechav ived pmd you details on how you can claim and what to expect realasticly.But through my company we are very quick and usually settle within 6-8 months unless the situation is serious.
anyone that has been hurt should claim as lot of people had time off work or its playing them up later on in life. you can go back 3 years over 21 or back to birth if under 21 if anyone has questions just pm me.

I dont get why people are having a dig at the guy. If his necks hurting then he's entitled too it. Thats what insurance is for. Even slight whiplash can come back to haunt you later on in life.

Would you guys not claim if you were injured due to the fault of someone else?

them injury lwayer for you are crap they treat you as a number on the end off the phone and once they get your business thas it u dont hear from them i prefer to meet the person and go through everything and keep them update every so on. and when you do speak to them u will go through to far east lol

maby if your concerned because she was texting you should contact the police and not the insurance company. They will be able to get a log of her mobile so no problems there.

But if she was crashed while texting then she must have crashed mid-text so it wouldnt have gone through anyway.

In all honesty though, who HASNT sent a text while driving?

if you were genuinely hurt then claim but if not dont in this instance though as i hate people being on the phone and driving i would either way just shows you why theres a law against it.

most phones still communicate every few seconds and t would probably prove the phone was active if it actually was.

Not sure myself on the story, lights went green as chav said, but he was actually looking in mirror as he seen her texting and then pulling away when lights went green. eyes in the back of your head anyone?

Maybe she said she was texting? It doesnt really matter, either way, she caused him an injury and he's entitled to claim.

If someone causes damage to your car, then people claim. If someone causes someone else an injury, they claim. Why shouldnt they? Your body is more inportant than a lump of metal.

Are some people saying that even if someone causes them an injury, they wouldnt want to be compenstated for the inconvenience caused by it, the pain/aching and the potential effects and restrictions it may bring later in life?

I got hit from behind at a speed estimated by the police at 35mph+ whilst I was stationary at some lights, £5000+ of damage to my car, Renault Megane in front was written off as the chassis was bent and the Megane went into a car infront of it and that needed a new bumper.

I seriously doubt you will have whiplash if you where hit by a car moving from stationary, but go and receive an X-Ray and you will know for sure, whiplash is bloody sore when its a proper case and not the ambulance chasers dream.

Really depends on the angle your head at the moment of impact (along with many other things im sure), but i got it pretty bad when a car hit me at about 20mph. The doctor said it was because i was looking right and had my head/neck fully extended at the time of impact.

I also got hit many years ago by a drunk driver at 60-70mph while i was stationary! Now that hurt!

my neighbour got stabbed in the hand by a junkie he caught breaking into his car the other night.had to get aids tested !! as the scum was hiv + i would think he should be looking at a few ££ from the criminal injuries people?


safechav would you be able to get mobile phone records to prove if they were using the mobile at the time?

Whiplash is a SOFT TISSUE injury, it will NOT show up on X RAY.

I haven't never ever, mo moby bill is less than £2 a YEAR, I have to intentionally use it just to keep it activated.
I have never ever sent a text period at any time to any body, whether driving or not, as I DON'T KNOW HOW, yes I am that old fashioned I let my 11 year old do that.
I did twice use a phone whilst driving, once following a drunk driver, on phone to plod, driver was convicted , and other time was following a DOG running along the road for nearly 3 miles I followed him at 15 mph on the phone to plod, behind him with my hazards on so it did not cause an accident.
I don't and won't have my phone swithced on, and don't even know what phone it is, IO just charge it once a month, then put it away again.
Roosie's company is VERY good, and roosie is a good guy to deal with, despite owning a chavvy evo 4!!
