My court summons for me supposidly speeding came through this morning!

It;s the bit that says although you have confessed becuase you haven't been read your rights "I must caution you that anything you say can and may be used against you in a court" blah blah the evidence is inadmissable in court. They need two bits of evidence to convict one being you confessing and the other being the photo.

Roughly, although the bastards may have closed that loophole.

ah...

well they have NOTHING!!!

I was stopped on the side of the road, by one police officer, and he didnt show me any devices to say i was speeding, just took my details and said i would hear in due course.....

i was stop like that year's ago. and nothing happened.

but i say nuffin about the 115mph and a speed camera. and not gettin done

Unfortunately IF it gets to court they will beleive the professional opinion of plod over you.

I know it is simply 'their word against mine' gonna go seek legal advice next week and take it from there.

The policeman has bent the truth on his witness statement too which hasnt impressed me much... but like you all say, theyre gonna believe him over me any day

In his witness statement he is claiming i was doing between 110 and 115mph over a three quarter of a mile stretch.

Yet when he pulled me over and gave me my caution on the side of the road, he claimed verbally i was doing a different speed.

Cheers Daviet - i will be speaking to someone next week!

Bugger all i can do really, but there is no video evidence, and the car had a 'single crew'.

From what i can find out, a maximum of a Ł1000 fine and 56 days disqualification is what i am likely to get.

get your boss to write a letter to the judge stating that you are a careful considerate driver and your existing clean licence + driving experience shows this (hoping you aint already got points ) mention you need your licence for your job and being disqualified will only cause you loss of earnings + have a bad effect on your career etc, hopefully this will help your side of the case and you will be let off (with probs the maximum of a hefty fine) which would be far better than any points and/or disqualification

or, forget the above, get yourself down to boots and purchase a tub of vaseline for whatever they gonna give you

either way, best of luck on what happens

how did he stop you?
how fast does he say he had to drive to catch you?
if there is no video eveidence then what are they baising the prosecution on?
what sort of road was it?
what sort of car were you driving?
how old is he?
how much experience has he got?
how can he judge how fast you were going over 3/4 of a mile without going that fast himself?
how fast were you going when you niticed him motioning you to pull over?
night or day?
was there other traffic on the road holding you up?
was there any other traffic on the road he had to overtake?

etc

Yes one Policeman - single crewed car

He flashed his lights and pulled me over!

He doesnt say hpw fast he had to go only '' My Volvo V70 Traffic vehicle struggled to catch the Z4''

No video evidence at all. Based on the police officers speedometer. Which is a sufficient amount of evidence to prosecute.

It was a dual carraigeway 'A' Road

I was Driving a 3.0 Z4

No idea on his age, i would say early 40's

He has been a traffic officer for 8 years and an advanced trained driver for 3 years according to his witness statement.

I have no idea.

I was quite possibly doing 90mph when i saw him flash to pull me over.

It was 11.30pm

There was no additional traffic on the road, although he claims there was in his statement.

He apparently had to overtake 4 cars to get to me.

so you were procceding along the road at a sensible speed (because you didn't know the area? there weren't any streetlights? there were no other vehicles and you dind't know if it was a busy road or not due to no other traffic being on it?) when you were flashed by a vehicle coming quickly from behind you?
and you didn't know who it was until he turned on his blues and twos to make you aware he was a police officer/officeress?
and he then gave you the long speach about going to fast ect?
which you refut due to it being late, no other traffic on the road, you were taking it easy, etc?
there was no need for you to be speeding so you have consulted with the legal profession who have suggested that it is not unreasonable to think that as it is a quiet night he may have just been "making up the numbers"?

is what i would do

was it your car? if not make sure the paperwork is all in order because they will try and fuck you for that too

if you were only doing 90 i cant see them succesfully prosecuting you on the say so of one pc. i had a similar when pc in his traffic car couldnt get his radar lock on me as we were going around a sweeping left bend and there was trucks on the inside blocking his view. his in car camera recorded his speed of 94mph to catch me up but i wouldnt commit myself to an answer over what speed i was actually doing during the interview in his car so he let me go with a caution.

you wouldn't want to be losing your job by driving the company car in an erratic or dangerous manner, besides, it's dark and it's a powerfull rwd car so it's even more of a reason to take it nice and easy

or play on the fact that, as a girl, you can't drive aggresivly or confidentaly at high speeds down country lanes and play the female card
