Default am i in the wrong????

i put a laguna splitter on ebay last week but i couldnt be botherd taking a picture so i used somebody else's on ebay,

so i sold it tonight then i got a message from the guy who i got the picture from saying he has reported me to ebay but i didnt think it was that bad, not worth reporting me any way

i wouldnt do it if it was a car of anything worth a fortune but its a £10 splitter???

am i in the wrong?

only thing that bothers me about this kind of thing is the fact that as a buyer you're not seeing 'exactly' what you're buying

as for the copyright thing tell him to bugger off

Technically if it's his picture you did nick it....but that's just like nicking a picture of a car from the manufacturers to then sell it used later on....only thing that is wrong is if the picture depicts an item you aren't selling....eg picture of a brand new unspoilt ford sierra in front of a nice sunset....and yours is 20 years old, battered, has no engine and gearbox and has had so many new panels it's an entirely different car to how it started (triggers broom anyone?)

As long as the picture looks exactly like what you are selling, no problems!

is there wording in your sale that says the splitter in the pic is not the one thats being sold or words to that effect?

just email him and say it's just a pic (but i see you've already had a go at that so )
