Default legal answer needed, mot types please

had an accident in the granada last year, nit up the arse
end reslut is that the off side rear door doesn't open as the quater panel has been pushed forward by about 2 inches

as far as i was aware, this made the car unroadworthy as i can't open the all the doors, and seeing as i couldn't drive it, i got a hire car instead

the other side have now asked:

"Would, in your onion, the vehicle that was damaged in the accident be legally drivable on the road? If your answer is no please confirm why you belive this to be the case."

i have refrained from sending them a letter telling them that they are thick cunts if they think i'm going to drive a car like that on the road, especially when i had a 4 month old that needed to be straped in the back at the time the car was off the road, but if this carries onfor much longer i'm seriously considering this option

so i need someone who does legalise type stuff to tell me what to write and an mot type bod to say it would fail and a constbulary type to say he'd pull me over and give me points etc if i were to drive it in that condition

so i'm not asking a lot

I don't know how it stands from an MOT'ers point of view, but surely for safety reasons all doors should open freely

i've baiscly said that as thedoor wasn't openable i did think it was safe to drive, and if it's not safe to drive then that puts the vehicles roadworthyness into question, and under those circumstances i would not have felt that it was legal to drive

sound fair enough?

I can tell you from a recent MOT that all doors must open. My passenger door was jammed due to faultly lock etc and I had to have it fixed for it to pass the MOT.

I would have to double check on this, but I seem to remember that you have to have access to the rear seats etc, but I don't think it states that both doors have to open. It's been a long time since I've done a test (over 4 years now! Doesn't time fly!)

The MOT manual is written in some bizzare code that no one, not even the people that wrote it understand, so a lot of the time it's how the tester interprets what's written. There are actually a suprising number of things in there that make absolutley no sense whatsoever, but because they are in there, that's the law. The tester can only advise on other things, even if they seem to be very important.

If there's no rush I can check at the weekend for you as I'll be at the garage getting my car MOT'd.

Was it the front passenger door though, as that does have to open.

I think it's different for the rear.

It was the front so hmmm perhaps the rules don't apply to the back.....

I've just asked another guy here in the office who has also been a tester in the past and he agrees.

The rear doors are not part of the test, but at least one must open to gain access to the rear seat belts, which have to be tested.

I will double check at the weekend just to make sure, but I think it's looking like it isn't an MOT fail, it's just a pain in the arse!

the issue is that junior would have been in the back of the car in his car seat so i would have had to get access to the back in any case, so i couldn't really use the car for what i wanted to use it for (transporting the little un about the place) with one of the rear doors not working

the link that alistairolsen put up seems to suggest that only the front doors need to be openable for the car to pass the mot test, but surely if you were carrying people in the back and then they couldn't get out would mean there was something fishy going on wouldn't it?
what about the case of an accident and they were trapped or something?

raising more quesitons than i'm answering ain't i

front doors have to be able to open from inside and outside rear doors only have to be opened from the outside side

didn't think of that..................

the door can be opened, but it's not easy and you have to give it a wallop from inside with the handle up

in saying that, it's been sat on the drive for over a year so i'm sure it's going to have been welded shut with the rotten rubber seal, even the leathers gone all green and mouldy

i am a tester and the rear doors have to able to be opened, untill recently , - as nick states there are some bizzare rules, i.e the front doors had to able to be opened from the inside and the outside of the vehicle, so the inner door handles could be missing but as long as the vehicle was presented with the windows down you had to pass and advise that the vehicle was opened from the inside of the car by reaching out through the window and vice versa, but rules and loop holes like this are now neer all written out
