Well, your landlord does sound like a very unprofessional one to me then. He's committing a criminal offence if the gas hasn't been checked. You are also entitled to 3 times the deposit if he hasn't paid this into an approved scheme.

Rent not paid: 4 x £600=£2400
Deposit normally month and half, therefore: £900 x 3=£2700

By my calculations the landlord owes you £300 pounds then

The whole situation sounds like a nighmare to me. The main problem is that lack of repairs, lack of tenancy agreement etc doesn't allow you to withhold payment of rent. However, you landlord sounds like a right idiot and looks like he owes you money for now. I'd say move out ASAP and let the courts sort it all out

Maybe he was hoping that he'd make a quick buck off you without providing a tenancy agreement, gas certification or repairs. However, if that's the case then the law is suddenly on your side, as a tenancy does exist even tho there's no paperwork. Sounds like a nightmare

For Chrissake.... just go to Citizens Advice or a solicitors. They have more knowledge about it than people on PF....

 

and take all your paper work with you rental agreement proof of deposit paid,
rates bills electric bills phone bills gas bills proof of income,all bank statements ,tax credits statements proof of benefits and job seekers payments, wage slips for both of you for the last 6 months.You need paper work for some one to give you professional advice,you will also need it for legal aid application and any other evidence to support your version of events.

If you didn't pay him didly squat then why should he bend over backwards to help you? I'm perfectly aware that he has a legal responsibility to provide you with various doccumentation and the like, but lets be fair about it - you havn't paid him jack shit so he isn't exactly going to help you is he?

 

He was paid the 1st months rent, and I'd expect that the 4 weeks that covered was ample time to effect any repairs and supply the correct paperwork.

We were already on benefit, if you read the post you'd see that. As for work now, the agency I have been working for placed me in a company last week, today I was made temp-to-perm, and on 21st Dec I become full time with the company,

 

Sorry, it was late when I posted, I was tired and a little bit agravated. We've been told that as it stands, if the arrears aren't cleared when it goes to court, that legal help in court would be useless. Although as we now hope that the arrears will be cleared in time, as soon as it is, then I'll take legal advice on the other issues, cross one bridge at a time, so to speak.
