Default Paypal problem

ive put a claim in for an item i havent received, and i put the complaint in this morning

seller has provided proof of postage, and said it could be lost in the post, it says on my paypal page its awaiting buyers response, but the only response option i have is to cancel the claim

now obviously i dont want to cancel the claim as im £100 outta pocket, any paypal boffins able to help?

this is the info i got off paypal

The seller provided the following tracking information for your review:

Postal Company:Royal Mail

Tracking Number:*************

Please review this information and determine whether you would like us to continue processing your claim. You may cancel this claim by clicking 'Cancel Claim' below. If we do not hear from you, we will resume our investigation in 2 days.

If you have a track number to go royal mail site & track it

If he has proof that he has sent it paypal has got nothing to do with it so you cant open an claim about that reason, your'll have to claim.. again using royal mail site.. if you havnt received it within 15days still

The situation depends on wether the seller used recorded delivery or just proof of postage.

If recorded delivery then you can track the progress and even who signed for the item when it was delivered via the post office web site.

If proof of postage then you cannot track the item as it just proves that the item was posted.

In both cases the sender has to do the claiming for compensation via the post office. If it was only proof of postage then the claim is limited to around £32. Paypal usually find in the buyers favour when the seller has only used proof of postage.

With recorded delivery, providing that it has not been signed for then paypal will usually find in the buyers favour as the seller can claim compensation from the post office as they have lost the item.

Obviously that is a generalisation but it does give you the general idea of how the system works.

Proof of posting is not good enough for pay-pal
if the item has gone missing they need to refund you and then they claim off the postoffice as untill you recieve it its their item that has gone missing...

I had this a while back some-one sent a laptop back to me that i sold saying it did not work (which i know it did), when it arrived it looked like it had been run over by a forklift ...
I did not refund them they had to claim off the postoffice as it arrived to me shagged..

he sent it 1st class not recorded or anything he said

just first class standard.

so paypal will refund me for the item then and obviously if it turns up then i can just send it back to the seller???

the " tracking number" doesnt work on the royal mail as it wasnt sent recorded or signed for

surely though if i havent got it thats the sellers responsibility to reimburse me and or sort out the claim???
