Default Car Accident

My old man and sis were involved in a car accident today. Not major luckily, but dad was taken to hospital as he had neck pains and was strecherd away in the ambulance, the other person was un injured. My sis is fine, and I think they are both a little shocked about it all.

Basically, my dad was coming down a main road entering a 30MPH zone, at this point doing the speed limit (in his work van with trailor on the back) the other car driven by a 75 year old woman is sittin at the junction looking at my dad approachin.... 25 mtrs....still sits there...20 mtrs...still sits there....15 etc... (dad not thinking she will pull out) all of a suddern, bang! she has pulled out infront of my dad and they had a collision at just under 30mph, dad wacks his head forward and hits the steering wheel and his neck is hurting (she jumps out and is fine) my dads van has a scuffed bumper, indicator and headlight are gone and bottom edge of bonnet is bent over that's it. Her car apparntly has more damage (wing etc) and is likely a write off.

Both were breathalized (my dad whilst wrapped up on stretcher still in shock and whiplash and couldnt breath into it properly )

Photo's were taken of the scene by my mums friend as the woman said "ooh I thought u were indicating off the main road to turn left onto the country road at the junction, it was sunny and the sun must have been shining on your indicator)

My dad had the trailor on and knows when the indicator is on as it beeps cos of the rear trailer lights etc, so she is full of shit.

In my eyes it is her fault, he is on the main road and she must give way to her right? unfortunately there were no witnesses bar my sis in the passenger seat

My dad is home now and OK, but he now cant get to work tomorrow as the car cannot be driven or touched as he informed insurance company off the accident and they are on the case and need to get him a hire car sorted. What are you views? I said claim whiplash and time off work (loss of earnings) and hopefully the old bint will get the book thrown at her

Cheers for the vote of confidence lads! It's more of an inconvenience to me old man than anything as he is a builder/plumber he has been told he cant work for a week.

it'll go in your dads favour as even if he was indicating and flashed, the old girl shouldnt pull out till your dad had turned the corner! same basic rules apply as running into the back of someone-always persons behind fault.

Cheers lads Tricky, yep, my view entirely! The cheeky copper on the scene even said to my mum when she arrived "how many times have you pulled out from a junction when people have been turning at a junction" Tossers, she replied, even if I did, I wait till they have turned the corner, it is basic highway knowledge Thing is he was never turning! fuckin stupid Coppers didnt wanna get involved I dont think. Ahh well, see what the insurance company's say....

Insurance shouldn't say anything its clearly her fault from the way you have told it
