Default Divorce, Spain, DVLA and HPI - Its a big mess

I'll try to keep this short

My Mother in law and her husband moved to Spain 15 months ago. She has found out that the morgage and other bills are not being paid and is starting divorce proceedings.

Now onto the car bit

They took their car from the UK and as far as I am aware it was not officially imported, she is unsure if its even been paid for yet

1: Can anyone please HPI it for me and let me know if it has been paid for

2: Where does she stand with the DVLA as it hasn't been taxed, MOT etc during this time and I dont believe its is SORN either due to her not having a UK address

Her finaces now are a huge mess (not her making) and it looks like she will loose everything meaning I'll get a long term visitor (ie her)

The reality of a marriage break down is that each party needs to look after itself financially.The fact that one party was kept by the other is irrelavant in a split look after number one the divorce law forces you too.I know this through experiance.Each party is responsible for it's self and it's owm debts from the date of seperation.

Understood

But its hasn't really help with questions 1 or 2 though

(I've edited the original post to add that her husband also moved to Spain in case it appeared she had gone on her own)

I can probably help you out with the Hpi

PM me the registration and car details.

I have a bit of experience in moving British cars to Spain, but I am unsure what you want to check. Give some more details and I'll try to help.

why were the paymenst not kept up and dvla notified of the export.
Can she not just ring her fianace company and ask or was it a car he bought and financed

looks like your mother in law is in a shitty position, while this won't do you any favours trying to get her out of the predicament she's in, will you be able to sort her problems out in spain just so that she doesn't have to live with you here?

She's doesn't know if the payments where kept up as her husband dealt with the finances (or not as it seems.) As he is the only one who has the infomation on the car and refuses to assist a HPI is the only way I know to find out as she is trying to find out the full extent of the current debt. He claimed he bought it for cash originally

I'll PM the car details over after luch, what she wants to know is if finace is outstanding before trying to bring the car back to sell as it was never officially exported to Spain as far as she is aware

At the moment we are trying to find out the extent of the debt, once we know this we will be able to make those decisions

At present 3 people are sueing them for non payment of debts (2 walked ito her work place to serve it hence why she found out), the morgage has been unpaid since before Christmas, the car is unkown but besides her house its the biggest asset

Anyone have any idea what the DVLA are likely to want fines etc and can I MOT it in spain to bring back to sell if its paid for already?

I am unsure what you mean by fines. If you mean the fact it has not been taxed then I think you can give them a decleration that it was out of the country, or if it was SORN then you should not receive any fine. (Not 100% about that so i'd call the DVLA and ask)

With regards to MOT. The Spanish equivalent is an ITV which are only valid for 6 months in the UK. If the car is here for longer than that then it'll need an MOT. Or if you're planning to sell it as 'roadworthy' in the UK it will need an MOT

The car has no tax or mot in Spain or the UK, as its a RHD 2003 Alfa I suggested she sell it in the UK

To her knowlegde her hubby has never

Exported it from the UK to Spain
Declared it SORN
Renewed the Tax
MOT'd it once it run out

I expect that once it hits UK soil a fine will be waiting

the car is going ot be the least of her worries mate
if they have defaulted on the mortgage payments then it may already be too late for the house
