Default Elephant Insurance Claim

About a month ago, i was drivin along through town at night, I pulled out of the roundabout and cut a cyclyst up (who had no proper lighting or refletive jacket ) and fell off his bike.

Obviously, i stopped, checked he was ok, gave him my details and he said is was ok and it was fine.

The other day, i rung my insurance company to ask if he had put in a claim and they said " No, we don`t have any records of it, so can we have his name + address so we can write to him to see if he would like to claim"

I replied " If he hasn`t rung you, then he does`nt want to claim". Quite simple really!

Since then, i received various phone calls and emails from the insurance company regarding the details they want.
Do I HAVE to give the details to elephant although he wishes not to claim?

Any help would be great peeps.........

Just say you only gave your details and didn't get his?

I have no idea where you legally stand with this though as you did report an accident and i'd imagine they can't ignore it, even though it would be in their best intrest to do exactly that..

Seriously they cant make you give the details as they cant prove it even happened? they're only going on what you've mentioned so as above say you didnt take his details, what more can they do?

I`ve told them that the guy said he might not even claim as there was not really any damage. I have told them twice on the phone that we do not wish to take this any further, but they don`t seem to listen (No surprise then). Is it worth me writing a polite but up front letter to them?

why did you call them anyway? now you will have to tell them for the next 5 years you have been involved in an accident even if no claim is made.

I'm guessing you thought he may try and make some sort of claim which you could of just denied unless he had some witnesses.

And surely elephant are the ones that will loose out if a claim is made so why are they trying to contact the other bloke

I called them because if he did try and make a claim and i didn`t contact them regarding it, then i would of been in the wrong. Also, there was a witness who was quite helpful and also mentioned that he should have proper lighting and reflective gear on.

Strange why you phoned up, should have just sat and waited. Prob nothing would have come from it. Insurance wont care anyway if there is no claim agianst u.

I used to be an insurance consultant and then I was a loss adjuster for household claims but..... motoring claims have the same sort of guidelines. Just tell them that you no longer have his details and that you had agreed that he was in the wrong at the time, just say that you wanted to make sure he wasn't trying to pull a fast one and claim from your insurance and try to blame you after the incident. If they wish to update this on the claims database (shared by all insurers) it will show as a non fault accident with no claim and therefore will not affect your premium in the future. I personnally wouldn't disclose it when getting quotes, because if it is dug up at a later date it will have no bearing on anything at all. Hope this helps set your mind at rest.
