Default About to get 'had' on Ebay....*Updated 28th Feb*

We sold an N73 a couple of days ago on Ebay for just over £200, the buyer contacted my prior to bidding and once he had won the item, he paid by Paypal.

Mistake number one, as I now know. That will categorically be the last time I use Paypal for Ebay.

Now, he has paid and I have posted the item to the address provided on Ebay. I have posted the phone, using Special Delivery.

Today, I got an email from Ebay advising me of a 'bid cancellation' by that user, who may be fraudulent. However, when I look at the auction it is no different and of course it is effectively done and dusted.

I feel as though I am just waiting for the Paypal payment to fall over and get clawed back.

I am fairly sure there is nothing I can do except sit and wait. Even though I have withdrawn the money, they can still put my account in a negative. What the fuck do I do? Just sit and wait and hope it doesn't happen?

I might be worrying over nothing, but it just feels as though it's going to go wrong.

Anyone got any useful input/advice?

No your not worrying about nothing and paypal can and are known to do worse than put your paypal account in negative.... this is why I will not use them

1. According to PayPal accepting their ToS (Terms of Service) in effect means you waive your rights to credit card consumer protection laws if you want to use their service,
PayPal can, will, and has in the past, completely cleaned out customers' accounts, (including your checking or savings account) with no appeals process available. Instead they bury in the fine print of 37 pages of their "Terms of Service" (ToS) where they disclose to you that PayPal can close your account for any reason what-so-ever, or no reason
Paypal is not a electronic banking institution and as such does not have to abide by the same rules and laws, it is a money transfer facility and nothing more.

It could be worth checking palpal sucks forums for similar thing and see how they turn out, but I personally would consider clearing out the account associated with paypal before they do

I am wondering about closing the account, but even then, I imagine that if the payment get's clawed back they will still chase me for it?

I feel as though I am waiting for something that will almost certainly happen, but I cannot prevent.

if it was me i would probably ring ebay and paypal and explain the situation and ask their advice...

i've rang paypal 2 or 3 times and they've always been helpful...

You panic and click the link, it ALWAYS directs you to an ebay page to login, where it feeds you further shite.... but the damage is done, username and password entered on teh fake ebay copy site.

Remember, I haven't had the chargeback from Paypal yet and may not get it, just the Ebay mails. They are in my actual Ebay message box too, so I guess they must be real. It is the very early signs, which is what makes it frustrating, I WANT to be able to do something to prevent it, but feel that I have to just stand there with my pants down and the vaseline ready.

Had this with selling a car. Got an ebay question asking if it was same spec as this other one. When I clicked the link it brought me to an ebay login page. Thought hang on, that's not right.... and didn't enter anything, luckily.

I got a spoof email yesterday about my account being frozen until i updated my card details... if the message ISNT in your my ebay message box then it IS a spoof... but if you've got the message in your ebay then its a real message!

Again i would call ebay and paypal and ask their advice personally

What worries me about calling them is drawing attention to it. I am inclined at the moment to remove my credit card details and bank account details etc from the Paypal account.

I am about to change bank accounts anyway and could easily close the credit card, so I wonder what they would do then? This is all assuming that the worst does happen. If they did claw back and my account just say negative, I wonder at what point they would start chasing you for the money?

The guy who bought my phone bought another at the same time from someone else, who has just left his feedback. I think I will contact him to see if he has any more info and, if nothing else, to warn him.

That's the weird thing. The email says the bid has been retracted, but the finished auction is still there with all the bids in place. Gary had one of these a while ago and it amounted to nothing, but his was only for a few quid.

I am re-assured by the fact that it has been a couple of days and would have thought that if they were going to claw back, they would have done it by now.

Whatever happens, this is too much of a close-call for me, that's the last time I take Paypal on an Ebay auction.

Well, only the one I cancelled. Nothing to do with this guy.

Here is the email I received from them.....

Mate, don't waste a second, get the cash OUT of your account NOW, and put a hold on it. You are being scammed

My mate sold an xbox 360 on ebay, standard sale etc, guy pays by paypal. So my mate goes to post office, sends it recorded delivery, pays on his card. Takes his money out of paypal and thinks nothing more of it.

My mate left positive feeback as the seller, but never recived any from the buyer...
3 Months down the line, He gets £360 TAKEN from his paypal account (luckily It was empty, so they just put him -£360 overdrawn, so none of his money went) by paypal, as the "buyer" has reported he never recived the item . So my mate contacts the post office, and gets proof he payed for postage on his bank statement, and sends it to paypal. They don't care, and have NO interest whatsover in helping him out, even though he is the victim and is being scammed.....

Paypal have sent him loads of emails asking for him to pay the £360, and he keeps responding saying ring me/ help me please, and they are doing NOTHING to help. They don't offer ANY support or interest, so he is basically screwed as its the buyers word that is taken as gospel

get your cash out ASAP mate, they take it from you no questions asked

yes this is the key, if it was a confirmed address your sorted an he can't recharge the money if you have proof it was delivered... if it was not confirmed the like u say paypal don't give a shite, exactly that happened to my mate with a phone!

i wouldn't do any sort of phone deals via ebay, phones and cars are the worst!

i would pull your money out anyway... that way at least you'll have the money and paypal will have to get it back off you(what exactly are they gonna do? except ban you from paypal - big deal), if they take it out you will NEVER get it back off them and you'll end up with no phone and no money!!!

my mate even got the police involved but they don't give a shit either.. the only hope is if the guy does 33mph in the 30 zone they pick him up

Update.

It has happened. Paypal suspended the payment a few days ago and have completed their investigations now, in favour of whoever's Paypal account it was, so I have lost £215.

The item was delivered using Royal Mail Special Delivery to an address in London. Surely it is the responsiblility of whoever lives at that address as someone there signed for the parcel. I feel like I can't just take it on the chin and want to do something about this scamming cunt.

When I go back to the account and look, there was no address on it, so I posted to the address on Ebay. As I tried to explain to Paypal, if there is no address, Paypal doesn't show that or flag a warning, whereas if Paypal gives an address that is different to what Ebay has, then you instantly know something is wrong. How on earth is it possible for a Paypal account NOT to have an address on it?

Anyway, I will post the info on where I sent it etc, if anyone has any idea's.

I am quite a placid person but am well prepared to make the drive. What worries me is that I arrive there and no-one is home. I then have to drive 120 miles home for nothing!

Have you tryed getting there contact details from ebay(the one they need to have to register on ebay) that way you can get there phone number(whitch is usally a home number) and give it a ring.

i feel i have been had too, bought some speedo clocks for £25 inc postage, never turned up. i payed by check so paypal not involved, was always a little suspicious of someone who wants a cheque, cos they have 'problems' with ebay.

thrid time i have been done now, and really getting fed up with it.

some bargains on there, but may just stick to local collections if items are expensive, plus i hate the way someone can pay you, you send it, and then paypal can just take the money back its ridiculous.

That address above is the Ebay address. There is no phone number on there and according to BT's site, that name/address isn't listed.

I can't see how Ebay offer you NO protection. I posted it to what looked like the proper address according to the listing that was won. The only mistake I made was that I didn't check the Paypal account address, which it turns out didn't exist.

At the end of the day, 2 people got scammed. Me and the guy whose Paypal account it was. How can they fall in favour of one or the other? We are both victims. What sort of seller protection is that?

First thing I am going to do is contact the guy whose Paypal account it is. There is a possibility that he doesn't know anything about any of this and it could be a scam involving ONLY paypal (regarding the money). It wouldn't be the first time.

Last time, I phoned the guy who won the item and he knew nothing about the chargeback. Luckily that time it was only £15 and I won it back anyway. The buyer had agreed in that case to pay for the item again, which was really good of him.
