Default Baliffs

What is the correct way with dealing with these coonts? No way am I letting them in, but how do I stand getting shot of them? Only asking cos I've just had a heated argument with some stupid cow about a debt I have, she wouldn't accept any offer of payment that I made, and reckons baliffs going to be on their way round.

If the baliff has a court order you have to let them in, and they can take goods to the value of the debt. Pretend to be out all you want, they'll keep coming back.

You can't stop them and being silly about it won't stop them. The vast majority of people they deal with do that.

They don't give up mate. I have done repo myself before, not quite the same but involves taking stuff that people aren't paying for and believe me, they WILL get you. They can take your car off the street if they decide to, the first you'll know is when it's on the back of a truck disappearing down the road, and there's fuck all you can do. Fuck all.

DO NOT LET THEM IN UNDER ANY CIRCUMSTANCE! OTHERWISE THEY CAN BREAK IN.
Phone the baliffs and give them an offer of payment and say thats it based on a pro rata agreement based on your expendable income.
If they say they will come round DO NOT LET THEM IN. Go to them or do it over the phone.
Once you let a baliff in they will write down what you have and then can break in any time they want.
Keep your shed, garage locked. Shut all windows top and bottom.
Hope this helps as I have had do deal with them before and this is how I dealt with it.
good luck, carl

some baliffs are quiet helpful and will take an offer off payment as long as you dont take the piss with it

is the outstanding debt a large amount?as already said each time they come around and you dont answer or are not in they add more fees.its not going to go away so unfortunately needs met head on.surely they must accept an offer from you to pay unless youve done that before and not honoured it? remove everything of value from your house and store it somewhere else then let them in and sort out some sort of sensible repayment arrangement as they will see you have nothing of value to take.not to sure about down south but im sure they cant take essentials like cookers, fridges etc only luxury items like tv's,computers and hi fi etc.contact citizens advice tomorrow

i worked for one of the biggest bailiff firms in the country and no matter what you say or do untill the debt is paid they will keep coming back And believe me everytime they come back your debt will go up by £50 at the least.

And you say you have offered to pay installments? once it has reached bailiffs it cant be done unless the bailiff accepts it without telling the office but even then you will only have probs 2 weeks to pay.

And if they get in your house your screwed basically they will do what is called a levy on all of your goods and they dont just take goods to the value of your debt they will take anything and everything which they think is of value, including cars etc of whatever you have on the drive or outside.

Also make sure all your windows and doors are locked if you go out because if they are not some bailiffs will just let them selves in lol and its not classed as breaking and entering either.

So end of the day your best off paying your debt cause it will end up costing you a fortune

Mate their coming to carry out an attachment and in all honestay if its a summary warrant there's not a thing you can do, i worked doing this for 6 years up till just a couple of year ago.

If you phone their office the wont stop it going ahead because once the order is granted then thats whats going ahead, when they come round they will listen to your proposals (think of one soon as). unfotunately they will price your gear up and they will now have a court order over them so any attempts to move them will leave you in contempt of court and they generally do sue for it.

now im not sure if they will accept your offer their it will probably go back to the office or court and generally unless your debt is quite high it will be accepted.

Sort out your income and expenditure, inflate your expenditure subtly not by big chunks and if you want to get rid of the debt and not just get the pressure of you make a decent offer

Dont just ignore it, they will get you if you dodge them. they can force entry wether your there or not and if you get really nippy about it they can obtain a exceptional attachment order (even essential items/non luxury) can be attached if they feel they need to they can uplift in the same visit (rare though)

Best o luck mate

If you think that bailiffs may call at your house, be aware that you do not have to let them in. However, if you leave any doors or windows open they have the right to enter through them. Once they have gained entry they may also force entry to any other parts of the premises. However, if you do refuse to let them in then they will be sure to return at some other time and the problem will not go away.

You cannot be sent to prision for not co-operating with a bailiff. You do not have to let them into your house. You should seek advice as soon as possible.

Form used to suspend the bailiff warrent

If you use that form when you receive the bailiff letter and make a genuine offer to pay the debt even by instalments its usually accepted

apologies if this sounds a bit chavtastic and tuff lol but it's true

baliff came to mine over unpaid council tax which i still say i didnt owe...duno if the same one came round but recall a few knocks over a few weeks...i ignored them.

one particular morning the door was knocked so hard it quite frightened me that the door was gonna come through , by the time i got out of bed i seen what was obviously a baliff putting sumat in the boot of his car. i went outside and lets just say there was an altercation, i never seen the bailiffor any other again .

BUT the bstads got me through involuntary deductions through my wages 3 months later which i'm still paying now .

proud to say i stood up to one

a baliff cannot force his way into a property unless there a sherrif baliff from a magistrate for a debt thats owed to company or a friend/person is civil debt . in short you dont have to let them in and they cant force entry

Do an income and expenditure analasis on yourself.

this will give you a figure that is your expendable income at the end of the sum.

This is then allocated on a pro rata basis to creditors and whether they like it or not, this is all a court will request and there is nothing they can do about it.

They will only take goods if you have ignored all previous correspondance and offers to make payments.

some one i know was £6,000 yes thats right £6,000 behind on
water rate's, rent, etc thay had letters up on letters still never
done anything about it thay ignored them,,

bailiff's turned up to price there good's etc and said thay will be back
the next day to collect,,,,

anyway after a phone call to the company thay advice them to pay
£2,000 when the baliffs get there and thay will be o.k but thay will
need to agree on paying some x amount a week.....

dont worry about it if you have expensive items in your home etc get

For those who said to just pay the debt, not making excuses but being on benefit at the mo means money is tight at the min. Its actually my gf's debt, and as for the offers we made, debt is £300, we offered £3 a week which they refused, minimum they'll accept is £5. One of the phone calls we had about it they basically had a go for not atempting to pay anything at all towards it so we ring up their payment ppl, to make a payment of £3 by card and get told its not enough. So as far as I'm concerned we've made offers and we even attempted to make a payment. The debt I have the fookers can whistle for, totally different company, goes back 2yrs, they got to find me 1st, forgot to tell them I moved a few months ago.

also they cant send a baliff straight off as to remove they try to collect payment if not then to small claims or county court then its removal goods time so as long as you can proove you have tried to pay a offer and been refused the court will be on your side and will do a means test and reinforce the offer to them

So you or she has nothing you can sell to raise 300quid to get rid of these people? I dont know the circumstances in which your debt occured but I know if I sold something of importance to me, to cover that debt, I would think very carefully about spending in the future to avoid it happening again. You obviously have a PC and Internet connection?

You should have paid the debts, you could have borrowed the money before you fooked up your credit rating for the next 6 years.Just because you have no money doesn't mean you shouldn't pay somebody. We all have bills to pay ,cut down on your out goings, do you drink smoke have a mobile phone broad band etc etc alocate your money to essential bills alternatively let them reposes the girl friend
