a m8 of mine won a bid for some car audio stuff on e bay the seller advatise saying these items were bran new never been fitted,
turn out that they were not new and they did,not work
is there a way he can get his money back from this weezle or is it a case

How did he pay? If he paid through Paypal then you can get your money back reasonably easily, just start the dispute procedure. Paypal tend to side with the purchaser in disputes

If he paid by cheque then forget it cause Ebay ain't interested.
