What is Copyright?
Before you go any further you need to know that there is no official register for copyright. It is an unregistered right (unlike patents, registered designs or trade marks). So, there is no official action to take, (no application to make, forms to fill in or fees to pay). original dramatic works, including works of dance or mime;


original musical works;


original artistic works, e.g. paintings, engravings, photographs, sculptures, collages, works of architecture, technical drawings, diagrams, maps, logos;


published editions of works, i.e. the typographical arrangement of a publication;


sound recordings, which may be recordings on any medium, e.g. tape or compact disc, and may be recordings of other copyright works, e.g. musical or literary;


films, including videos; and


broadcasts.
So the above works are protected by copyright, regardless of the medium in which they exist and this includes the internet. You should also note that copyright does not protect ideas. It protects the way the idea is expressed in a piece of work, but it does not protect the idea itself.

But what it says is: if you find a picture on the internet it is protected by copyright laws even if it is not marked with a copyright mark.
But for better protection from theft the author/photographer should mark his pictures with a copyright mark followed by his name.

From my brief, and I mean very brief, view over the first statement you have made it seems that unless the said item, be it a photo or a piece of music, is not clearly marked then the owner has no legal leg to stand on.

In all fairness I would be a bit miffed in the same situation, if they didn't even ask me first! I would undoubtedly say yes if they did ask, but it's just good manners to do so!!

If someone asked if they could borrow my car, I might say yes, but if they took it without saying bugger all assuming I wouldn't mind then I would be fuming!

We tried to contact the original source of the pics when they were used but were unable to do so.
We saw the post yesterday and asked the people involved to contact us and so far we've had nothing.
If whoever took the pics doesn't get in touch with us, how are we supposed to take this any further?
If you look in the front of the magazine, you'll find an email address for the magazine, my email address, Ben's email address, Dave's email address, a postal address, a phone number and a fax number.
