Started seeing this lass who like me is seperated but not yet divorced.
Now her Dad gave her his old car as a gift(no money changed hands) but because she doesn't drive the car was registered in her Husbands name.
So when they split he took the car.
But of course it's now annoying her that he's got a free car.
So the question is this.
If it was a gift to Her from Her Dad is she the legal owner not the ex?
If she can claim legal ownership, how can she go about re-claiming the car?
Mike

The name on a log book is NOT proof of ownership, purely registered keeper so the authorities know, who is responsible for the car, tax, mot, etc.
She needs to obtain a receipt from her father with her name as the new owner, signed and dated.
It will be best if the date matches the date the log books were exchanged too.
A receipt is the strongest piece of evidence of ownership proof.
She then has a case to retrieve the car, unfortunately the difficulty comes as the original log book would have to have been signed by the previous owner allowing the exchange of keepers.
It wont be easy to retrive however the receipt will be the best starting point.
