Default Ebay dilema

Bit of an odd one this!

Guy buys a pair of seats on ebay from me - buy it now. Hes got a pretty sketchy feedback of 75%.

He pissed me about for 3-4 days deciding how he was gunno pay but finally sent me a cheque. I paid that in Monday and it appears to have cleared into my account.

He sent me an email Tuesday night saying that he couldnt afford to pay for them and the cheque will bounce

So, I went ahead an filed a dispute on ebay to claim back my listing fees etc. He has yet to respond to either the dispute or my attempts to contact him.

I havent told him that the money has cleared and he seems to have gone quiet.

Do I just pack up the seats, send em to him as arranged and just say tough, youve paid your problem, you sell em on to get your money back.

Or..... do I just send him a cheque for 120 quid, keep my seats and try and get my fees back?

wait for a few more days .. be certain the money is in your acount .. then do what you feel is moraly correct ...

Morally, I should give his money back...

But hes pissed me and others around, so maybe loosing some cash and getting stuck with something he doesnt want might teach him a lesson.

Yes but could he not do an indemnity claim and claw the money back when he realises? That could leave you out of pocket and with no seats. I would be inclined to wait for him to contact you. If the money has gone, and he can't afford it, then he WILL be in touch when he realises.

No mate thats very wrong, Ł120 is alot of money imho.
He might be genuine about not being able to afford them. I have once bought something over ebayer and got robbed that night so obvously didnt have the cash, i just offered to pay his fees and he was fine with it.

I would send the money back as you dont want old bill knocking on your for theft do you ?!

hold fire, if you can leave the Ł120 on your account but no more, contact ebay again and him saying that he doesnt want the seats anymore and cant afford them, explain the money has cleared into your account and it is still there and will stay there untill it is resolved, also state that because of this you will not send the seats untill you know whats going on,

as above, if he cant afford them then he will be in contact but i reckon its a case of he wanted them but after cheque was sent/cleared he found another set cheaper and is trying to fob ya off to get his money back.

it doesnt sound like a scam but if you did send the seats and the cheque is legit then theres nothing he can do as the cheque has cleared, unless it wasnt his cheque to start with...

i would hold off untill ebay has sorted it, if he dont contact you then thats his problem not yours, just keep paper copies all all emasils to and from him and ebay, if you did have the bill knocking at your door which i dont think will happen you can proove your not a scamer and your just trying to get to the bottom of it.

might be worth calling the bank aswell to see if the cheque was/is legit and not stolen etc, just explain it to then also and go from there really

I dont think its a robbed account, the cheque etc is in the guys name.

Ive sent him one more message saying unless he cooperates to get my final fees/listing fees returned then I will be sending the seats and keeping the cash, since he doesnt seem to bothered to just agree with the dispute.

fair play, but i wouldnt sedn the seats till i heard from him, tell him you lost his address and need it again, if he wants them he will contact ya.

on the other hand, he might of needed the money to pay his internet bill and has since been cut off so he cant read emails.

remember mate, that just because you paid it in monday and it show as avilable balance, the cheque still hasnt cleared yet so it might still bonce, wait for it to clear fully and the cash IS in your account
