Default Need help with con merchant

I just bought an exhaust for my bike off e-bay coz I am not rich enough to buy a new one.Anyway I went to collect them and he had it all wrapped up in a black plastic bag.I ripped the bag open at one end to see if it was rusty where mine was and it wasnt so took them.I must add at this point that I had e-mailed the seller before bidding and he said the exhaust had surface rust only.When I got home I looked properly and there were gaping big holes in the down pipes.I have left negatve feedback and his reply was that I tried to give him the old one off my bike (which is still attached).I am soooo mad at being ripped off and I want revenge.I am thinking that he sold the exhaust but it is not fit for purpose nut If I take him to court he can claim its my old one.An expert could tell if mine has been disturbed but obviously I cant drag the bike to court,.Can anyone give me some advice please.I have never ripped anyone else off and dont appreciate being ripped off by this low life.

Would have to agree with Jim on this, seems a fair option.

As you went round to collect it, you accepted the goods it's not like buying a car or something with mechanical parts you can't see that may break later, you had the opportunity to check the exhaust over before accepting it and there's a thing in law [sure others will confirm this] called "buyer beware" [not a difficult concept and pretty self explanatory in the name ]

Having said that, did you give him the chance to refund before posting negative feedback?

as above really YOU should have checked it fully m8 as he can say anything really ie IF you wasn't happy with it why did you pay him?

Yes.I gave him the chance to refund but he said tough.Sadly I paid cash.I am a bit stupid in a way and take people at face value.I remember he said he was on benefits coz of his bad back and couldnt work but then showed me his merc van that he delivers bikes all over the country with.Might give trading standards a call.

cheers Paddy.I might just do that.Im not into grassing but he deserves everything he gets.I feel so angry at being ripped off.In fact I feel so mad I could petrol bomb his shed (at the end of the garden with 3 bikes in there).

YOU pay his benefits from your taxes!

i'd have NO issues grassing up someone fraudulantly claiming benefits!

It's not a case of grassing mate, if he IS claiming and working, he's getting paid money out of our taxes so it's just another way of getting some of your money back - or at least making sure it go's to someone else that may deserve it

I think you only have yourself to blame. I would be to embarrased to put a post up like this in the first place. Dont hand over cash with out checking the goods fully!!

But anyway it has been done, so presuming you know his address and he does NOT know yours.
I would go and launch it through his front window.

It is a pretty funny story tho.

we all make mistakes and why is it a funny story?

the guy works on trust like so many of us,and yes we have been fooked over at least once in our lives it not the buyers fault it wanker that mislead him in the first place.

People like this really piss me off.
