Right here goes i had for sale a full unused zvh motor with all the bits and bobs and a few other bits for sale as i was breaking my series1, now i sold the engine to a lad of here who came to view the motor and put £50 deposit down and agreed he could pay it in the next couple of months(this was in early november). He decided at the time he wanted the full motor, gearbox, polished header tank and rear quarter windows so we came to the sum of £1350

Last week i get a text saying sorry i cant buy the engine, so i thought fair does take it on the chin as i have only received £250 in nearly 4 months so that will do for my inconvinience, and besides he has the box windows and header tank so at least he has something for his £250 so fairs fair.

Now yesterday i get a text saying the box turns out to be a standard non turbo gearbox and that basically he wants some coin back.

Now i agree i sold something that turned out to be not as stated (unbeknown to me) and that the lad is out of pocket but imo he let me down BIG time and nearly lost me my new car by basically not paying what he said he would, so the scenario being do i or dont i

ps just read that it wasnt an rs box, he still got some other stuff out of it so id be mostly inclined to say sold as seen.

but 2 months is quite a long time to get fucked around tho mate, and as it was a DEPOSIT they arent usually refundable, but he still got something out of it

you never agreed to sell it in bits did you? i bet you did a decent deal as he was having the whole lot, so the way i see it is you should knock some off the total price, if hes not doing the deal then its irrelevent. He either needs to cough up for it all minus a discount for box or stfu and think himself lucky he has something to show for his deposit!

Right the £50 was the deposit and then 3 months later £200 was the first instalment.

The only reason he got the box and other bits is because i needed the space in the garage, now dont get me wrong i do feel shitty that he got a standard box but what would he have said if he had give me £250 and i hadnt gave him anything

That crossed my mind!

It could be looked at two ways.

1. £50deposit thats non refundable. So in effect he has paid £200 for which he has a box, polished header tank & what Im assuming is rear qtr opening glass windows. (Id say that was fair price & he has got his £200 quids worth)

2. He returns the box, the header tank and the rear opening qtr glass & gives you some ££'s for the inconvienience.

Personaly I dont see you as being in the wrong at all!

Some little toe rag has put 200 quid on my Dads Tomcat, he's knocked the door a few times to tell me he's getting the other 450 together, he's defo haveing it blah blah.

I dont care, he's paid his deposit and he can have the car when everythings fully paid or nothing at all.


As for the box, you should have checked it was what you said it was WHEN you sold it and so should he.
Once its left your sight it could have been swapped for somet else, used and broken, buts swapped internally etc etc.

I know how to tell a genuine RST box (presuming we're on about one).
I have purchased 2 or 3 to know this and wouldn't dream of buying one without checking.
In fact the last one I got off IANS2RST from Sheffield who I trust not to sell crap or rip anyone off (as he's a good/genuine bloke) I still quickly checked before handing my wedge over.

(its very easy and with the box removed and drive shafts out is OBVIOUS)

And so should your guy who's purchased this item- buying a 2nd hand box is a big enough minefield without not knowing if its the genuine article or not.

Header tanks gotta be worth a ton?? and the side glass I'd have thought 40 quid so to get a box for 110 quid is a bargain.

A deposit is money to keep goods or a agreed time , this stops you selling the items to anyone else .
we all know what a deposit is for and know that if you give one then back out of a deal for whatever reason then you loose the deposit .
I hate it when people call you and ask for a deposit back , whats the point of giving a deposit if you dont have the funds to buy .

Also why take a depoit ( from a sellers point of view ) if it isnt thought that the deposit is there to keep if you get messed about

I think you have been more than good about it and should tell him to forget about his deposit and think twice before he buys other items that he hasnt got the money for

im the lad who was buying alps's engine so im the person ur all telling to fuck spiders !


not i anit some little chancer or knob jockey what happend was that i intended to buy the motor at the end of the month

but due to circumstances changing im selling the car and moving top the usa ,

now i told alps ( which hes forgot to mention ) that i didnt want the deposit back ( 50 quid ) as it was more than fair , obviously i went to see rthe motor late november and whith crimbo on the doorstep i didnt want to have fuck all till the end of january ....

now he could of said when i told him in december that it was going to be a month or two , that he had to get shot asap and that he couldnt wait that long but he didnt .


so when ive come to sell the box on to a mate with a s1 ( a friend of both me and alps ) hes came back to me and said upon inspection that it aint a s1 box its just a xr3i lump .

this box hasnt been switched or pulled apart as he was back at my house 15 min after he took it ,

now i understand where alps is coming from really i do , but all im saying is that ive shelled out 200 quid on a used header tank , a pair of rear windows and a box that is now where near worth a hundred quid .


and i know that alps didnt mean to sell me a xr3i box , as when i came to look at it it was in the car still , even our mutual mate thought it was ..

so i reckon im out of pocket

not alot but still im out of pocket .

now i aint been greedy or a stingy fooker but i cant afford to be loosing money here and there like some people might be albe to ...

so thats my side of the story ,

now i wasnt aking for alot back , was only thinking 50 quid . but its more the principal of the matter ,

if the roles were reversed and he had a legitamte reason like i do than id do something to smooth the matter out with him

The mounting points on a S1 and S2 box are different so it may appear its not an LSD box because it doesn't look like the one he has.
BUT how has he checked if its an LSD box or not because the acid test of dropping the clutch and seeing if 2 black lines are left aint gonna neccesarily work on an old 2nd hand box is it?


I still stand by what I said too to be honest- You should have checked what you were buying before you bought it/picked it up as it still sounds like a resonable deal to me.

after all that just a little question for you alps pacino my mate has actually bought the engine of you but according to your first post beefy was gettin the engine and all the other extras for £1350. However you have charged him £1350 for just the engine and then your on here havina bit of a moan that you might be out of pocket nd what should you do.But its my mate whose bought the engine thats been shafted by you, so if those bits come in with the deal you struck so do those bits belong to graham then?? Or you making the money up of him for waitin as long for beefy???????????? I think thats rather shocking mate.so you shud give beefy the 200 bk for header tank n other bits n they should be passed to graham imo....
