Default compensation claiming from the council?

hit a major pot hole last night on the A640 rochdale rd,
just of jct 21 M62,

my wheel nakered, 2 inch gouge in it,

has any one claimed any thing from the council before for things
like this?

just wouldlike some advice,

get photos of your wheel AND the pothole if possible! theyll try to cover it up rather than pay out!

As above, eusure you have pics that cover the surounding area aswell.

An indication of the hole depth and the date of pic may come in handy. (maybee worth takeing a copy of todays paper and a measuring tape)

You need to take pics of the pothole & the damaged wheel with say a newspaper showing the date in the pic otherwise they'll try & fob you off & get the pothole covered.

A girl at work is currently going through this with her local Council.

Last winter she hit an uneven badly cracked surface in the road and it threw her car into a ditch upside down, it wrote the car off and she got trapped inside, a week after the Council resurfaced the road.

They are currently refusing to acknowledge that the road was dangerous in the first place and want nothing to do with her.

She has written to them one last time threatening legal action and an independant ombudsman, they are likely to ignore her again at which point she will have to take them to court.

So........... after that long winded story I say good luck, but dont hold your hopes up, could be more hassle than its worth.

Ps: This was covered in the local press and the council still wont budge

I fought Edinburgh Council for an engineering defect for over a year and have now given up.

They can afford lawyers etc more than I can, and in the end I decided it was a company car and their insurance paid so why stress? All it cost me was the aggravation and the damage to my pride.

The commany's insurer bought two new alloys, two new tyres, and a front woishbone, plus a laser alignment check.

You won't be claiming against the council for this as it happened on a motorway. You will need to be claiming against The Highways Agency. Unfortunately there is no way you can photograph the pothole legaly as you will need to be out of the car which is an offence you could get stung for.

I'm afraid you are quite likely to end up being stiffed on this

don't bother m8 my m8 spent ages writing letters worded from a ex traffic sargent took photos and everything and got no where what so ever only if it's been reported previously have u some sort ov case if u can get anywhere hope this helps altho not what u wanna hear

I got compensation from the council (Essex county council) for a split sidewall
They paid up in full with not so much as a receipt
All I did was write them a snotty letter explaining what had happened (BIG pot hole) and generally complained about the poor maintenance our roads get and the amount of tax we pay, I followed this up with plenty of emails asking where my money was and they sent me a cheque

I know this pothole on the A640 well - its been there a good few months, its a propper big crator

got a bollocking from a copper for going onto the opposite side of the road to avoid it aswell

find out who is resposible for the road, ie which council , then ask for their insurers and deal with them direct...

usually best to get a council rep to meet you at site and show him , dont take no for an answer, i had a problem yrs ago and it was on a bridge over a motorway, which meant that i had to deal with the highways agency(shiteheads) and they eventually paid out.....the insurers for them were/and Zurich municipal!
or spk to your insurance comp as they do provide you with legal assistance!

Apologies I misread the original post.

I read it as happening on the M62. Not my fault I'm getting old

Yes you should be able to claim against the council for the damage to your car. The trick is to not allow them to fob you off and keep pestering them until the cheque is sent out.

Judging by th epic they will try and pass the blame off on the water board as it seems to be their reinstatement that has failed leading to the hole. Push hard and they should stump up.

i wacked a pothole ant it crack an alloy.. sent pics etc, and they sent a letter claiming some bullshit.. never paid out

Agree with that, although it looks like a temporary reinstatement, try writing to the water company, whovever that is in your area??

i do work for Severn Trent Water and if you hassle them enough they will pay out, or get the contractor who reinstated it to pay up.
