Default Advice please - Recorded phone calls

Hi,

I have just been on the phone to a debt recovery firm who have wrongly been trying to get me to pay them instead of another firm.

They sent me a letter this morning saying that I should start paying them immeadiately.

So I phoned them up and spoke to some cocky young lad...

He was saying I have no right to be paying them etc, but then he said the firm that I am paying, are part of them in some way or another.

To cut a long story short, I swore at him and hung up...

BUT it said at the beginning of the phone call:

"Calls maybe recorded for monitoring or training purposes"


So am I in trouble, if they have recorded it ?

The words mentioned were: "bollox" "f*ck off" and "cocky" "cvnt"

I am now a little worried, if it was recorded

I have swore down the phone to a few places Capital One being one of them, and i aint ever had anyone contact me about it.

in my experience they only tape random calls and if ur unlucky one of them could be yours..or on the other hand maybe it wasnt..

ive only experienced one company who tape every call so depends really but i wouldnt worry about it

I was just wondering what legal implications it had, if any. And what they could possibly do, if it was recorded.

Don't worry, there shouldn't really be any trouble. These sorts of companies have to put up with it all the time. I used to work in a call centre, all our calls were recorded, the main reason is to prevent any sort of fraudulent activities and for the company to cover their own backs, as in if a customer accuses them of something during a phone call they can back it up with their own evidence. In my own opinion I wouldn't worry about it mate. Truth is, if any one says anything, all you have to say is you got a bit heated, it is a touchy subject after all.

Legally I can't see any implications, it's verbal abuse which as far as I can see at most is a warning, if that

Course you wont get in trouble, all they'll do is make a ntoe on your account that you were abusive and they may only let a manager contact you in future.

If I were you, contact the Company you think you should be paying and ask them if they are affiliated with them.

Look at it as a case of them harassing you! You were wound up!
Im sure the company and its employees are used to a lot of verbal given the nature of their job.

I get abuse from Customers every now and again, trust me they wont do anything about it same as we dont, all the person would have done is hang up then moan to their collegues that you were an arse then prob say that they dont want to speak to you again. TBH if they are a debt agency they will have calls like that all the time - so they prob wont bat an eyelid.

I am assuming you didnt threaten to kill the poor jobsworth?

as for the recorded call, nowt will happen but it sounds as though the original company you owed cash to have now took on this debt recovery firm to get the cash back for them, for which the recovery firm will charge a percentage of the debt for recovery plus admin, i`m sure this is payable by the original company you owe to, and not by yourself, two lads i work as a doorman with run debt recovery companies, so any other info you need let me know and i will find out as much info on what you can do.
btw if you pay just 2 quid a week off your debt they cant touch you with bailiffs etc.
