last year, as many of you know, i had a bit of a bad day at work, basically, a fatality.
cut a long story short, had to go back, check for life etc etc only to find a woman in 3 pieces.
got a letter today from my solicitor saying that CICa (criminal injuries compensation association) will not pay out because my injuries were not "severe enough" to warrant a claim.
fuck me - i see dead people and was seeing the company counciller on a regular basis to keep me from going insane, and then i'm told that i cannot claim due to my condition not been serious enough? - not even offered to pay my loss of earnings due to the incident

can you not appeal, take it to the local paper, etc.

i'm better yeah - but absolutely hate going to blackpool on the train so avoid it at all costs.
i can appeal, going to get some paperwork from my counciller to get a picture of my state of mind about the situation as i still aint 100%

thats sux a fuggin big un i know only to well how shock affects you and have a claim ongoing for 4 yrs now mental injuries are looked on diferntly to say a broken leg fuckin wong tho yeah ya cant work with a broken leg but you cant either with a broken head! did you go straight back to work? see theyd look at it like this if he can work hes ok sad but true, on the flipside i read of a woman that witness her daughter being dragged under a bus she sufferd ptsd symtoms for 2 yrs (flash back visions feelings) and was awarded 50k

i went back to work a week later, then had another incident where i thought i saw a body in the same place (give or take a mile) ...............psycological problems?
in hindsight, i should of taken weeks off as i wasn't right to be working, but went back as i was still on probation (6 months probation from day of starting) so didnt want to create a bad impression

steve - i was the guard yes, but the driver didn't do fuckall - i went back and protected the line, contacted the signaller, informed controll, checked the victim for lifesigns and all the other dangerous bits while the driver did fuckall apart from sit there
suprsising, no matter what you was doing on the train, that you can see a mashed up body, get fucked up about it, and cant get no compo.

Your employer/union/company counciler all sounds a little too tight to me.
IMO consulting a independant legal specialist would be worthwhile.
Dont be disheartened.
Knowing that you have suffered as the innocent party & fighting for recognition of the detremental impact it has had on your life. Is worth fighting for.

mate the fact that you were concious enough of creating a bad impression shows you were of sound mind when in shock you cant think of shit see i aint a pyscologist and ive booted your claim out already just going on what youve told me ptsd (bodys nattural reaction to massive shock) can last for 5 yrs and affects you in some fucked up ways thats the only injury pyscologically you could claim for, for "witnessing" something shocking think thats were theyve said nay tbh but if you do find it bothering you dont hesitate to go see a shrink thier nowt wrong in it thier just people that are qualified and experienced enough to know the answer to the questions you ask yourself but have no answer to

I'd guess that they should maybe pay you while you were off sick, but compo? My boss won't pay me if I see a fatality on the road, even if I'm first on the scene and try to help.
Find out who the dead woman is and sue her estate. If anyone is liable for your distress, surely it is her?

Unfortunatly mate your willingness to go back to work has worked against you
Been talking to a friend of mine whos a claims brief.
I know its to late now but:
Back to work? Cant to traumatised
Go to counciling? Cant to traumatised
Relationship problems? yes due to trauma of the event.
Unfortunatly chap this is the only way you would have got anything.

Forgot to add,
If Graceland had a relapse causing him not to be able to leave the house due to flashback etcs - and the current councilour reminds him to much of past events then he may be able to get away with an independant assesment - and maybe compo. But thats not definate.

Is the driver claiming and if so is he successful??
As, if he just sat there as you said, surely you have a stronger case as you actually did something about it at the time??

whilst i was driving for a living i saw a guy on fire in his vehicle (leg still twitching) , a guy died trapped in his vehicle (while i was holding the drip) seen loads of crashes happen . it does affect you if you let it. never tried to claim tho' cheers nomad

Nomad - i see your point of view m8, but this incident has litrally stopped me doing my job properly for sometime now, just ask churchy what happened when i was on the phone to him while on that route.......

i totally agree - the driver may well of been in shock, but still - he is trained to protect in an emergency as you will know been a senior driver - if i had not protected and cautioned a train coming on the up line, then the driver of that too would of been running over the remains of an inconsiderate tart who took her life and that would of been more people off work
But as you know Shock affects people in different ways.
Nobody can say how they will react when this happens.
No amount of training is going too help if you are that shocked.
We always look back on a incident and say what if we done this or that.
Like i said you done exactly what you was trained to do, which is brill, hope you was thanked for your actions.

shock deffinately affects people differantly - the severity of the mornings events didnt sink in for me untill i was walking round B&Q in the afternoon - i froze and dropped everything i was holding

i was offered councilling, after i asked for a differant manager to deal with the situation.
chain of care etc etc - went to see the company counciller a few times, and i still detest going to blackpool on the train

he aint nope, however, i am under a different manager now as we have 3 trains managers 
the other manager was fantastic, did absolutely everything
