Default Is this a write off?

Happened last night, some bloke indicating about to pull into a car park that i was leaving, so i pulled out but he ploughed straight into the side of me. Says he was indicating for the next turn in (about 30 meters further down !)

Im a bodyshop owner and i would say it defo a write off, parts, materials and labour would far exceed the value of it

yeah thought so, im gutted as i had a new clutch literally 20 mins before it happened. will i be able to claim for it?

yep write off and fault accident.

Lesson learnt, you shouldnt pull out until you are sure they are turning in, ie massive speed drop and starting to turn.

Incidents like this and also people flashing to let others out seem to be happening more and more, especially with insurance fraud.

I'm fairly cautious when it comes to people flashing to let me in or out, I usually wait until I can clearly see their speed dropping, or had a good look at the driver to see they are looking my way. It's a judgement call we all make on a daily basis.

Id rather wait a few seconds and piss off the driver behind than risk getting rammed pulling out or turning right.

But usually i have my right wheel on the centre line so people can get past to the left.

One of my pet hates is FUCKING CUNTS who turn right yet sit in the middle of the lane blocking the road when there was plenty of space to the left if theyd positioned thier car correctly.

but to the op, your fault, car write off, if you want to retain the salvage then so be it, how did the other car look? might be better to drop him a few quid than to go through the insurance if it's a shitter

id agree its a fault claim against you, and the cars a write off. A x reg fiesta is worth less than 800 and to paint and put a new bumper (let alone a wing etc) would cost more than the vehicle is worth.

A indicator is an indication they intend to change direction, not where they change direction, he could have spotted a parking space 5 yards up from you and was intending to park there.

Until I see massive speed decrease, or front wheels turning I do not go. as far as the law is concerned you pulled out on him - simple as.

However in your defence, his signalling may have been confusing, see 103 on the highway code

While I agree the car is a write off I wouldn't be so sure about your responses regarding who is liable. Google Winter Vs Cotton, the claimant is in exactly the same scenario I was in. The defendant was liable due to misleading signals

when did i say i was blocking the road? Dont make assumptions based on my brief description of what happened. I was asking about the condition of the car and whether to expect it to be written off

The Highway Code makes it clear that a driver on a main road has right of way but the court will look at all the circumstances surrounding the accident including signalling, behaviour and witness evidence

Yeah annoying isnt it.


The other bad one i see a lot is when im driving at the speed limit or just over and want to turn right, usual MSM. move to the right and the impatient cunt behind moves to overtake on the right!

Id say now if im turning right with a tailgater, about 80% of them move to overtake. its usually asian taxidrivers in a hurry or boy racer types.

deffo write off. Had a mk6 tdci zetec at work witch had a scuff on front bumper witch could have fixed with out new bumper would have needed new headlight and wing and they write it off! shame as it was a nice car with only 80 thousand on the clock.

What? that's just a new front panel really? Actually really annoys me how easy they write things off. First accident ive had in 11 years, it may only be an X reg fiesta but me and my mrs had some good times in mine too, still gutting irrespective of the car.

Its currently sitting in a local garage yard. They arnt charging me for it and they are local. But insurance said I cant touch it until they send someone out?? Pisses me off really, Im a student and work nearly full time and id have repaired it myself to save money but as I said cant believe how easy they write things off.

Most cars in pounds get robbed of parts. Mate of mine found his car at a local yard still on the lorry (police called to have it moved) he could see the guys in the yard almost rubbing their hands together He then went to the office and demanded them to take the car to his house which he paid for.

They could not refuse as he is the legal owner.

Right ok, well im going to get on the phone to them. I thought it wasnt right. Its my car so should be able to do what i like with it.

I had an RS turbo'd xr2i that i put backwards through a hedge late one evening. When id went to yard next day to get it towed back to base for stripping, already the alloy cooler and rad was gone, although luckily the thick thieving cunts had taken it off that day and the bits were sat in the staff room so i repossed them. They tried to claim they wernt mine despite having scratches and drill holes id put in them I think if id been on my own rather than with 4 forces mates then i might of got a kicking

The issue I have is opportunistic garages charging huge amounts for insurance jobs. The insurance claim they can get cars fixed at the best price, but that's bollocks, mine could have been done for just the excess alone. And if you want to find your own garage they make it really difficult. I couldn't care less about the value of the car in money, its what I value it as a means of getting to work.

My mates car was a cossie.... Another mate inquired about making a claim due to water damage insurance said we will need to collect car to assess he said no send someone out. No shit 2 hours later a low loader was out by his house to take it away (escort cos) he didn't claim in the end and still his renewal went up until he phoned and sad he had not claimed.

think it was about 10 years ago and a guy i knew (who's name i can't rememeber now) had a janspeed engined turbo'd xr4i which he rolled into a field

they came to recover it and took it to a salvage place about 60 miles away

he did claim but by the time he went to collect the salvage yard said he woed them £1200 for storage

he paid up because they knew what they had and they made it pretty obviosu to him that if he didn't pay up there and then they would simply have broken the car in front of his eyes and his payout would have been £0 because he was only 3rd party
