Default Had a big accident today (insurance help needed too)

Well today on ma day off i decided to go manchester to do a bit of shopping, was going along the M62 in the 3rd lane just before junction 12 when a log about 15-20ft long came of the back of a flatbed wagon span through the air and straight through my window screen!

Was nothing i could do, cars behind me cars to the side and infront etc, so just positioned ma car as best i could as it span through the air towards me. Got as close to the central res. as i could and slowed down as best i could without the guy behind hitting me and the log went straight through the passenger side of the window into the seat, damage the a pillar, roof and passenger door. My mate was meant 2 b cummin with me but didnt, and good job coz he'd of been killed, and so could I if i had of stayed in the same position instead of moving. Was going to pull over but when i saw the truck keep goin i joined the motorway again and chased after him and managed to get his reg. and the police came out to me etc.

Im fine and trying not to think of the what if's etc and just happy i position maself as best i could to avoid being killed myself.

Anyways got straight onto elephant.co.uk who have been sound so far, apart from when i mentioned i want to take up the option of using my hire car cover, to this they have said im not entitled to one, as its not included, ive read over the t&c's and it says i am even though im TPFT and on ma premium total breakdown it says "car hire cover £26.62"

So ive paid for it, its clearly stated and yet i cant have one, plus they want me to take it to 2 garages for estimates, well i cant drive the fucker!!

Is it me or are they totaly in the wrong!!

jesus christ mate that sounded scary!!

when someone knocked my dads car in a carpark he had to go to 2 body shops for quotes aswell, the amount of phoning he did was unbelievable just to get a pay out!!

well the cars not drivable so god knows how they expect me to do anything.. but as far as i can see, if ive paid for a hire car within ma premium, and its in the t&c's i can have one then i can

I've had this (not elephant though) - The hire car will be for "while your vehicle is being repaired"

So, until the time a garage is actually repairing your car, you won't get one.

If they write it off, you won't get one.

Sucks

nope he didnt, either way i got his reg so he's gonna get screwed by the fuzz for failing to stop.

By the way it wasnt the RS2000 thank god, was in my daily run about!

is it normal for third party to get a courtesy car?? most insurance companies ive looked at only offeer it for comprehensive... but if ur sure then keep fighting for it!!

I work for an insurance company,and it isn't Elephant!, does it actually say that you have paid that premium for the c/car or is it just stating how much it would cost if you had taken it
Most schedules of Insurance are very confusing,you will need to speak to Elephant and state what you believe,ie you paid the premium,they will be able to check this very easily,if you didn't and it is just showing the premium if you wanted it,then you cant demand a c/car,and will have to fork out for one yourself .

as a truck driver and this is no defence these truck's are so noisey if something does come off the truck he may not of heard it cant look in your mirror's all the time. as for failing to stop did you try to stop him did you get his attention if you did and he drove off he is a disgrace to our trade .if the police do get him i think it will be hard to prove he left the sceen of an accident he will say he did not see it no excuse i know but they will have him for unsafe insecure load. just hope you are ok mate you were very lucky thou mate. Most solicitors do a free consultation, basically so you can get some advise Id prob pop down and see one of them with all your documentation see what they say!!!

Sorry to hear that mate although in the Lorry drivers defence it is highly unlikely that he would have seen the wood fall from the trailer. I work in Road Haulage and I see this kind of thing regular - normaly cars getting hit on roundabouts and things. Unless the driver is looking in his mirrors at that moment he would know nothing about it.

However, all Haulage companies are bound by very strict guidlines in how a load should be properly secured. They have a DUTY OF CARE to ensure the load is secure. The penalties for anything falling from a lorry can be quite severe and may harm his/their Operators License.

As for the c/car I would think that they may only provide when your car is away getting repaired. So get it booked in somewhere quick

Defo says i go the hire car, gives me my total premium and then a break down of how that figure is put together. Apart from in ma cover booklet It says:

Car insurance prem £xxx
insurance premium tax £33.93
personal accident cover - not taken
breakdown cover - not taken
Hire Car cover - £26.62
Credit charge - £57.68

Total - £xxx

Mate as im writing this now i got im filling my grinder up wiv sum fine quality doubage mate.

Ive been at the hospital since my last post as my back neck and shoulders just seized up, and whilst i was there my left arm went numb and still is, and ma knuckles have gone purple, gotta go for physio 2moz now. Definately gonna claim from injury, hope i can play ma guitar 2moz.

But thanks everyone for your posts, gonna get back on to elephant 2moz and kick off, should of been ringing me back but havnt
