Default Licence/Points Question

If you get disqualified under the totting up procedure (12 points) take a 6 month ban, get your licence back, then get 6 points again, is that your maximum? Because i was lead to believe and from what i can find on google and various sources that its basically as follows;

First ban under totting up - 6 months, then licence comes back clean

2nd ban after totting up another 12 points - year ban

3rd ban after totting up another 12 - 2 year ban

Do it a 4th and its revoked/have to retake test?

I ask this because ive just had a debate with a police officer about it who seemed to have nothing better to do than to want to play question time with me whilst i was on my way home, i was pulled for ' wandering under and over the speed limit by a few mph ' how petty? She told me if i get any more points i will have to go back to court for a decision as im already on 6 and that is the maximum you can have within first 2 years of getting a licence back? Ive had it back just over a year.

Im really confused now.

copper is full of shit.

6 points rule is for new drivers within 2 years of passing driving test.

Thats what i told her, i said ive got another 6 points to play with then she began saying if i want to argue the toss she will give me 3 for speeding so i just kept my mouth shut and went.

I find it rather sad that someone has nothing better to do with their lives than to trawl an internet forum playing cluedo, whoever you are on about, i can assure you its not myself, i used those pictures as a reference which i too found on here under the search facility, i was warned about some of the small minded folk on here on another forum.

Did someone tell you that points make prizes?

The idea of this game is to NOT collect points or bans, rather than racking up as many of each as possible.

Apart from anything else, what will it do to your insurance to get banned repeatedly whether in one good hit or via totting up?

I have had 2 bans for totting up and both were 6 months..
They were a few years apart so don't know if that affects it..

Well the copper was adament if i get more than 6 within 2 years of getting it back its back to court again, though other sources you get 12 to play with right away.

Don't be so quick to say someone is full of shit.

If a person has been disqualified, and is then ordered to take an extended test, they return to learner status, must apply for a provisional licence and are subject to the rules governing new drivers.

It may be the case that the new drivers act would apply, but I can't find any reference to this, so it's a little bit of a grey area.

The New Drivers Act only applies to the 2 years after you pass your first UK test in any category. If you exchange a foreign licence, you aren't affected by the Act, but if you then pass a UK test to add, say, a motorbike, you are under the Act for the next 2 years. Simply being disqualified and passing a new test doesn't restart the clock.

What happens after you have passed your re-test
The New Drivers Act only applies once. You won’t lose your licence again if you run up another six points. But if you get more than 12 points in three years, you’ll normally lose your licence for at least six months.

as ian mac says.....


also note the increasing scale of 6, then 12months then 2 years for totting up only applies if you get back upto 12 points within 3 years of your last totting up ban.

so you could get a totting up ban every 5 years and each time it should be a 6 month ban.

however with all serious driving offences, the magistrate can always be a cunt and ignore the guidelines and give out a stiffer penalty within the range he is allowed to hand down. The magistrate just has to justify it.
