Default Problem neighbour question regarding fence

If a fence is deemed as OURS, and a neighbour from the other side of the fence removes a support bracket, would that be grounds for defacing property or whatever you want to call it? as i said the fence is ours and is actually on our land, not his.

Before doing anything, go and have a chat with the neighbour in question and fins out what's gone on and why. Might be a more simple solution to it all that you first think

Can you clarify how it's actually on your property, have you checked the deeds? I imagine in would be covered under some sort of vandalism/criminal damage, but you need to be able to prove he did it.

No no no mate, you dont understand, we havent got on with him for years, we have constant issues with him and his big Pinocchio nose. he did it because hes got nothing better to do than annoy and medal with other people.

His property is on this concrete ground raised one inch from our driveway, the fence is on our driveway, not on his raised concrete path. But i would have to double check first that its definitely ours, but im pretty sure it is.

And any case why remove the support bracket anyway? and also forgot to mention he chucked the metal bracket on my driveway...................... i really could knock him out but i will not do him the honour of seeing me being taken away in a cop car etc.

if its just a support bracket then dont worry bout it ! it might of been rotten and he's going to replace it. if your looking down your garden from your house you are responsible for the left hand side only it should be in your deeds.
look at the party wall act to pal

The fence panel is brand new with new parts, so no its no rotten or in need of replacement.

Sounds like a dick, but unless you actually saw him do it, then there's not alot you can do. Perhaps if you went to his house and asked him if he saw anything or anyone, and give him the chance to admit it, if he's a twat then i'd report him, not that they will do anything but it might be a deterrent in future.

Yeah hes a proper twat, we are silent, never make any noise etc, never even speak to him or acknowledge him, but yet he carrys on. I think the fact he doesnt work and stays at home all day doesnt help He had a harassment order put on him by the previous neighbours about 6 years ago, and more recently he was told to "fuck off and get away from my house" from the guy about 6 houses down, every time he walked past his house he would stand by the gate watching the work men do work on his house and ask them questions and stop them from working, then the final straw was when he asked the workman if he got permission to install the gas tank he was having fitted.

Proper nosey twat, he needs to get his own life

Sounds exactly like a problem that's happening to someone else I know, they had the same issue with a fence that fell down, guy A) Approaches neighbour and asks about mutual costs to fix fence, he says "F*ck off", so guy A) gets fence repaired, then neighbour complains to police etc and sloictors are involved saying it's substandard blah blah blah, so he ripped it down and left it a mess, then built one further back in his own garden and left the guy with the mess. Sweet! TBH that kinda sounds like what's happened with you seeing as you have a fence in your own garden.
Doesn't sound like you'll get anywhere without hassle, personally i'd just go round and tell him to mind his own fcuking business and that'll be then end of it as far as your concerned.
