Default Drink driving,young lad needs some advice.

Hi all,my sprayer came in today practically in tears as he's been caught drink driving,he's only 19.

He's been seeing some slag from up the road,25,divorced with 2 kids,no job but a high sex drive,so of course he's been loving it,her own place and she does all sorts.she's been a proper head fuck to him,rubbing stuff in his face(not the way your thinking!!),asking him to move in,telling him what he wants to hear,getting the kids to call him daddy etc,you know the score!!

He took her 40 miles up the road on the weekend for her to go to a rave on her own(????),he reckons she was proper slutted up as well.he dropped her off and phoned her to check she's ok(bit insecure) and she tells him she's going somewhere else with a girl she's just met(????).

His head goes and he drives off to a mates.one too many at 5am he decides to drive to her house(stupid boy I know),gets there and it's party time,boys he's never seen,she's off it by the sounds of things,creating,fucking his head up again.they argue,he boots her laptop and jumps in the car,drives about 1/2 a mile down the road past the cops who are on their way to her house as she's known to them.he pulls over on his own and phones her,copper answers and tells him to come back to the house as his ex told them he'd smashed the laptop and drove off pissed. Naively he goes back and tells the copper everything,gets arrested etc,night in cells,charged with dd,he blew 64,limit is 35 iirc?

Now,normally I wouldn't get involved as i'd say stupid boy etc but this is SO out of character for him it's untrue,he's an exceptional lad who'd be an asset to anyone,he works like fuck and is really good at his job.he's never been any trouble to anyone and comes from a very hard working family.

Iv'e written a detailed letter explaining the importance of him retaining his license but I'm not stupid and realise a ban is inevitable,what I'm wondering is,how long can he expect.the cops reckoned 12 months but maybe less although one other person told me a minimum of 18 months then another no more than 6?any help greatly appreciated.

i reakon 18 months ban and a fine..and they will offer him a drink awareness course that will knock some time off.

Silly boy, but its easily done for a young lad at that age to do silly stuff. Your letter as his employer should really help altho I feel a short ban is inevitable. Hope he dont get fucked over too bad.

Make sure he gets plenty of overtime and you work him into the ground so he's got no time/energy for shagging sluts

I've never heard of anyone being banned for less than 12months when its drink driving.

Always been 12months minimum.

Can't you keep him on at all if/when he loses his licence? Just doing jobs in the bodyshop? Obviously not ideal but if he's as good as you say he is then might be worth it.

Often it's 12 months, reduced to 9 after a course/series of courses.

Deed's done, matey was in the wrong (despite all the circumstances) so he's going to get the time, no matter what.

I've never heard of a DD not get a ban because of extenuating circumstances.

Thanks guys,some great responses.I'm closing up rather than working longer I'm afraid fella hence why this has come at such a bad time for him as he fancied giving it a go himself although with no license it ain't gonna happen sadly.it's hit him really hard,I was pissed at first that he didn't phone me as I'd have told him to get the fuck out of there and dissappear for the day til the booze wore off,would have made it very hard for them to prove it then but hey ho.the cunts even told him to come up the house for a chat only knowing they've got him then to breathalyse etc.

16month ban. Minimum, plus on that he will have a fine of around Ł300 plus her costs for the laptop.

Edit to add, you can go under 12 moths on the ban but after a driving course.

Say for instance the passenger was going to die unless you drove, and you were slightly over the limit, the court could be minded to award an conditional discharge.

In this case he possibly could get 12 months (reduced to 9 if the DDR course is offered) or 18 months (reduced to 14-ish with DDR). Senencing is not black and white though, so he needs to be going in knowing he minimum is going to be 12, rising to no more than 24.

Heard of the course and put that in my letter and agreed to personally take him to assist his rehab blah blah bollocks stuff!!!!

Thankyou,kind words.silly thing is we've both warned him off her before as she's picked him up and dropped him a few times.he's a young lad with a big nob that should be going in young girls rather than old milers!!!!Although she's 10 years younger than me!!

I know someone who was 3 times over the limit, yet walked out of court with a Ł246.00 fine , no point, no ban

Due to a clever specialist solicitor,

Solicitor cost him Ł1500.00

Apart from him everyone else 12 months ban minimum

My Apprentice blew 42 and got a 12 month ban reduced to 9 months if he does a driving awareness course, and a Ł300 fine. The harsh thing is above his case in the local paper another lad was double the limit, crashed his car into a tree and got the same ban and a Ł100 fine. So my apprentice rang the courts to find out why the other lad got a lesser fine. Apparently because the other lad was in a low paid job and had broke his leg the courts went easy on him!!

as bad as his curcumstances are at the end of the day he was drink driving and could have killed someone because of it hopefully his ban will teach him a lesson

Is there nothing that can be done with regards to the Police Officer phoning him and telling him to come back. I.e being under the order of a copper, for all they know it wasn't him driving away from her house. They've told him to drive over because they need a chat with him?

TBH it sounds like a ban will do him good in reminding him not to risk everyone elses lives drink driving just cause he gets over emotional about some worthless chav slut.

The solicitor ran rings with technicalities round the polices evidence & procedures.

But it is true. I was the lads boss at the time & he was a sales man with a company car. On the morning of his court case I had already made the arrangement to send his car back to the lease company.

I was well surprised when he walked away with a Ł246.00 fine & sod all else .

His solicitor apparently only did dd cahrge cases. Was not cheap but .......

Dojj, he has already told the police the truth, so making up lies that contradict him now will win him no favours with the court.

He wont be getting off IMHO, so he just needs to seem as sorry as possible and hope they are leniant, lieing wont help him now.

No,he didn't drive back,he drove off from her house,got about half a mile and pulled in cos he knew it was silly to drive.he sat in the car and phoned her to try and sort it out but a copper answered the phone and told him to come back cos of the broken laptop and the fact he'd driven off under the influence. He asked the copper what would happen as he'd only been a short distance and the copper said it was a chat to sort it out.he walked back and got done as soon as he walked in.personally I'd have switched the phone off the minute that nob answered,locked the car up and legged it for a few hours but hindsight a wonderful thing.

Agreed,much as he was stupid to do it in the first place he's no shirker and has 100% held his hand up.the arresting officer has written an excellent report saying how cooperative he's been and how fucked up she was.he's not expecting to get off but I'd like to see him have some sort of reduced ban if poss,but I don't make the rules.

I dont think that would be classed as entrapment, but it may well be the case that a copper deliberately ordering someone who is in a car drink driving to return to a scene, is in some way against procedure and some sort of technicality he can get off on or something like that, thats where expensive lawyers come in!

true.. but if i had my way he would sit the ban any way.

maby when he is with out his car for 12 mounths or so he will realise how much he needs it and will make him think twice next time the situation pops up.

it took me well over a year to get my driving licence and 6 tests

but out of most of my mates im the only one who has not been on a ban have no points and have never drinked and drove (ive come close but dont fancy sitting another 6 tests )

and ive had my licence for 4 and a half years now

bad aint it lol i have no truble driving beleave it on not (spelling is a different matter)

but when im put under test conditions i panick realy bad my driving instructer used to get realy pissed off at me as there was no need for me to have any more lessions but as soon as that guy or girl sat next to me in that bright yellow jacket i drove like a spazz

it was the same when i took my MOT testers course i can mot a car no problems but when i new the guy was watching me my mined went blank and i failed. got it the second time tho i was pumped up on redbull lol
