All they are doing is bringing a lot of heavily modified vehicles under the same rules as kit cars requiring them to go through an IVA test.
This is supposed to only effect "radically altered vehicles" and that is still a rather open definition.
Looking at the regulations the way round it is to build from a new shell with mostly new parts and go down the kit car route as a "kit conversion".
Where theres will theres a way.

As of yet there is nothing stated in the MOT testers manual if you want to 4x4 cosworth your focus with 200 or 1000 hp you can end of as long as everything testable on the car passes as with a normal MOT test the only hurdle that may affect you depending on year of focus you are using dependent on year will either be 0.5 or 0.3 co limits
Hope that helps.

Doug - The emissions test goes on wether the vehicle OR engine is older (for engine transplants).
For example, you put a 1992 Cosworth 4x4 engine into a 2007 Focus shell then the emissions test will be for the age of the engine and not the vehicle.

Thing is most of these laws regarding cossie converted cars etc already exist its just that it has been hard to enforce as traditionally the MoT man doesnt care if its radically altered as long as it pass's the safety aspect of MoT, where as if DVLA gets its full way then presenting a radically altered vehicle for MoT might be harder.
Thing is technically if you do a cossie conversion then you should go through IVA anyway as its a rebuilt/RAV anyway. Its just that people have been getting away with it so far.

Vehicles Fitted with a different engine
Test according to which is older, engine or vehicle.
e.g. A 1995 car fitted with a 1991 engine (of whatever make), test to 1991 standards for emission purposes.
Note: The onus is on the vehicle presenter
to prove engine age.

Like you have just posted Warren its on the tester to prove that the engine is older than vehicle hence why the rule is in place ( Test as presented ) Now if customer has relevent paperwork i.e. engineers report to prove age of engine then yes you can test on engine and not vehicle age.
