My friend has bought a car... a 15k mercedes....
they did one of them £5 data checks and seemed o.k, she collected the car this week... now it appears there is finace outstanding on the car.

She bought the car private and cant get hold of the man, also paid cash.
my husband has been round for her, but seems the man dont live there.

Looks like shes has been truly done over....

is there anything she can do?
is she going to lose the car?

do you mean a hpi check has been done ?? if a hpi check has been done correctly and your friend has given the hpi all the correct detail's then i think you can claim from hpi if they say everything is clear and it's not

 

Not being funny, but last time I did a HPI it was nearer £35, sounds like your friend might have been conned twice if the £5 check is also a con

Best of luck, as said above, if real HPI, you should be able to get some form of redress from them afaik.

But as said if a proper legit check was done, sure they will be covered in some way and have to pay sumit out .

I've been out of consumer finance for a while now but I seem to recall that in a private sale, so long as she bought in good faith, the finance company can't take the car away, but she can never sell it either as she doesn't have good title.

Buying from a trader, the finance company are entitled to take the car back leaving you to pursue the trader for your refund.

Someone n here will have more up to date info than me though.

 

that isn't correct if you buy from a proper trader they will persue the trader for the money not the new private owner

oops sort of summons up what might have gone on here, but if she's lost her money then the only person she can blame is herself

unles she has paperwork from the checking company stating that there is nothing outstanding on it, then she can take them to the cleaners

 

My memory is hazy on this subject, but there was a presumption that a Trader couldn't be an "innocent purchaser" because he had access to the likes of HPI and was expected to use them - failure to do so was not a defence.

That meant that as the trader could not be considered an innocent purchaser, he couldn't have good title, so any subsequent sale was invalid and the owner (HP company) was entitled to recover the goods.

However, if the individual had bought from the trader in good faith he could be argued to have good title as the "first innocent buyer" and that was where it started getting messy and my involvement ended...

 

Used to come accross this loads at work, Sometimes it took Seller/Finance company Months to get the finance warning taken off the car.... 1st thing to do is contact Finance company and find out whats what.
