Default House Advise

Hello just thought I'd ask where I stand as an individual in a joint mortgage.

Basically my girlfriend and I have a joint mortgage which I pay for have split up, she is staying elsewhere at the minute, but coming home daily to pick work clothes up etc.

I know I can't kick her out and black bag her, (I'm not a complete tosser!) We have only had the house 8 months and have to pay fee's etc if we sell during a certain period, she wants crazy money to leave, which tbh I don't want to give her, I would rather sell the place

She is saying she isn't going to pay any of the fee's but expects half the profit once sold.

Just wondered where I stand and if anyone had any advise on what to do?

Knock half the fee's worth off her sum payout Just hope you have copies or recipts of where the cash came from when getting your dipper etc



I will get my mate to post up how he sorted his out, his ex wanted to take him to the cleaners, ends up she owed him 'rent'

If you only lived together 8 months and you pay everything surely she cant claim half ? Its not like its been long term

Thats what I was gonna do, sell it and minus what I paid out, she 's gonna be a pain cause she has for the last 6 months

If you can ask your mate that would be great, just can't wait to see her out on her ear!!

if her name is on the mortgage she should be paying half whether she lives there or not.

If you paid for everything, the mortgage is in your name and you are not married I don't think she needs to get shit
See a solicitor -this happened to me in the past and seeing a solicitor is money well spent

just read it again and it's a joint mortgage
still see a solicitor as if you can prove you paid for everything you may still get lucky

Deffo need professional advice. Guessing the payments will come straight from your bank account? As long as 1/2 the payment doesn't come into your account from hers then that's proof YOU pay for the whole lot regarding mortgage. A plus point on your side there. Just got other bills to sort/ prove then.
Get proper advice from someone who deals with this all the time mate

Advice is to see a soliciter, happened to me. Half is a fucking fairy tale. Unless you're married she only gets out what she's put in. If she's paid half to the cost of running the household then she gets half, its all proportional to how much you contribute.

If she cant come up with transactional evidence ie bank statements paying stuff into mortgage/bills etc then shes in trouble

same happened to me mate , joint mortgage , she moved out , got a letter saying £12000 equity! so she thought she would walk away with at least £6000! ha got on to a mortgage adviser and bye the time you take in to account the redemtion fee for getting out of your agreed mortgage early , solicitors fees , valuation fees and estate agents fees , we would av got £500 each! i offered her £2000 and she took it , so i keep the house. Now we back together and she pays me £400 a month rent hahaha

our old next door neighbour split from his wife, he is a computor programmer and one of 3 in the contry that does this certain program so he was very well paid

she left him, took the kids and mad him pay the mortgage on her new house, plus £1100 childcare per MONTH for the 2 kids. she doesnt work, hasnt for about 10 years...

hes now fucked and cant afford the shitty house he now lives in

so, option 1 is kill her off

option 2 is get someone else to kill her off!

Good advice, I like the kill her part quite a bit though

The payments for the mortgage and council tax come out of my bank but she pays the bills, gas elec, phone, sky.

Gonna see a solicitor tomorrow and go from there
