What is Copyright?

So the above works are protected by copyright, regardless of the medium in which they exist and this includes the internet. You should also note that copyright does not protect ideas. It protects the way the idea is expressed in a piece of work, but it does not protect the idea itself.

But what it says is: if you find a picture on the internet it is protected by copyright laws even if it is not marked with a copyright mark.
But for better protection from theft the author/photographer should mark his pictures with a copyright mark followed by his name.

From my brief, and I mean very brief, view over the first statement you have made it seems that unless the said item, be it a photo or a piece of music, is not clearly marked then the owner has no legal leg to stand on.

In all fairness I would be a bit miffed in the same situation, if they didn't even ask me first! I would undoubtedly say yes if they did ask, but it's just good manners to do so!!

If someone asked if they could borrow my car, I might say yes, but if they took it without saying bugger all assuming I wouldn't mind then I would be fuming!

 

But surely, if you can prove beyond reasonable doubt (witnesses, datestamp etc.) that the photograph was taken by Person A, and reproduced/distributed by Person B without Person A's permission, it's open and shut...

We tried to contact the original source of the pics when they were used but were unable to do so.
We saw the post yesterday and asked the people involved to contact us and so far we've had nothing.
If whoever took the pics doesn't get in touch with us, how are we supposed to take this any further?
If you look in the front of the magazine, you'll find an email address for the magazine, my email address, Ben's email address, Dave's email address, a postal address, a phone number and a fax number.
