Default Consumer help required-seriously need some advice please

My Fiance has paid for her wedding dress and now the company is closing down,(NOT bankruptcy apparently) initially she paid half as a deposit and then recently paid the rest on the promise of the dress arriving last Friday at my mums house being delivered by DHL.
The owner of the shop wont answer her phone, saying that her daughter has gone into hospital, the number we have been given doesn't seem to be hers as some guy answers and says he will take a message for her.
Now, I wasn't worried about this until tonight as I thought it would sort itself out, but now want to know how I can either get the money back or get the dress delivered.
Can I find out the owners home address and pay her a visit for a face to face discussion, if so how do I find it?
Can someone please help as my other half is really upset at this and I am wanting to get it sorted straight away.

well technically thers 2 route here

The first one, is that yes you could find out her address from the Companies House in London, i think it will cost you a tenner. BUT, if she has registered teh business from the store address then you could be stumped.

If she has closed down then she is honoured to supply the goods under a consumer act. However if she is being made bankrupt then techinically any third party who is owed financially and seeks recourse will have to go through the solicitors who are involved on teh process.

Other than that mate i dont know. Id suggest contatcing the Trading standards

This happend to the company I worked for - a musical instruments company, and the owner decalred bankruptcy(sp)

I hate to say it, but the hundreds and hundreds of people who had paid for guitars, piano's etc in good faith and were "awaiting delivery" (in reality the delivery was never gonna happen - the cunt embezelled the cash and never ordered the customers stuff ) never got shit. It all went to liquidators, and I don't know what happened after that. I know I am still out of pocket by Ł1500 for wages owed etc...

Damo it was paid by Debit card, not credit

How are you doin anyway-you seem to be a bit quieter on here recently

Visa Delta Defo claim back, Meastro prob still worth a try, dunno if you go through your bank though... ??

I'm not bad mate, been PROPER busy with work etc, so not been able to get on here much.. or do anything much in fact LOL

It's a current account Visa Debit card - doesn't say if it's Maestro or Delta though like mine does?

reminds me of when powerhouse shut down and i knew someone who had stuff on order that they were never gonna get... they just got some mates together and stole stuff up to the value of what they had ordered when it was handed over to the recievers.

if you get the company registration details you should be able to find out. Failing that, contact the police. Oh and Good Luck!

If the firm is a Limited company you can pay Companies House and the Directors home addresses are listed. But if her business was a sole trader or partnership she won't appear there.

I don't think you will have any rights to reclaim off your debit card as you aren't borrowing if you use these, and the protection on Credit Cards comes thanks to a clause in The Consumer Credit Act 1988 (but it won't hurt to ask).

A major learning point for everyone here is ALWAYS to use a credit card if the cost is over Ł100 (the cover doesn't apply below that level), even if you pay your money into the card account before making the purchase. Whatever, just make sure you settle at the end of the month to avoid the high interest charges.
