Your usage
In our terms and conditions, which you accepted when you signed up for BT Total Broadband Option 4, you agreed to an inclusive usage guideline of 50 GB per month.

However, we've noticed that you have exceeded your usage guideline for a second consecutive month . Your usage last month was 87.93 GB and your previous month's usage was 155.01 GB.
What happens next
This email is to confirm a charge of £37 for your usage above the threshold for your product last month. The charge relates to £1.00 (inc. VAT) per GB. This will appear on your next bill. Related charges will continue to be applied if you exceed your usage guidelines.

Anyway out of this?

might be worth trying to get out of it on the basis that they didnt warn you that you were going over your limit. I know it worked for a mate of mine, she complained right royal about it. It doesnt stop the limit being in place though

It does clearly state that 50gb is your limit and exessive use (which yours is) will command a charge.

Its not as if youve just creeped over cause give them their due they do let you away with it. Your miles over


The solution is a new provider with unlimited downloads but i think u will find 99% of those are 'accpetable terms' and doubt they wil let you download 150Gb without charging.

mines proper unlimited because ive been with them couple of years and they cant change the contract

back then it was much more sensible so they didnt need to restrict

tell them about what a good customer you are and how much your custom SHOULD mean to them. they should be able to reduce it a bit....

Contest the amoutn being charged as unreasonable if there's nowhere in the T&Cs that actually states the cost of the charge.

but what is fair usage .. im sure you should be able to contest fair usage .. its quite loosly quoted .. i mean my idea of fair usage is probably nowhere near theirs

Eagle - true My idea of fair usage is fuck everyone else - I want ALL the bandwidth

According to Tiscali;

Tiscali's Fair Usage Policy is designed to make sure your broadband service is quick and reliable whenever you use it.

A very small number of customers use Peer to Peer or file sharing software, which constantly sends and receives video and other very large files, throughout the day. This type of activity uses a lot of bandwidth and can significantly reduce the speed at which other customers can access the internet during peak hours. Approximately 1% of customers use more than 30% of the available bandwidth during peak hours. We don't believe this is fair to the vast majority of our customers.

This fair usage policy automatically identifies the very small number of extremely heavy users and manages their bandwidth only during peak hours (6pm to 11pm Monday to Sunday), to protect the service for all our other customers. Outside peak hours, the use of the internet by these heavy users is unaffected.

We think this is the fairest approach. It protects the quality of service for the vast majority of our customers when they most use the service, while at the same time allowing the extremely heavy users to continue to send and receive without restriction outside of peak hours.

How do I know if I am likely to be affected by the Fair Usage Policy?

If you don't use Peer to Peer or file sharing software it is unlikely you will ever be affected by this Fair Usage Policy. If you do use Peer to Peer or file sharing software, all we ask is that you use this software considerately and send and receive large files outside of peak hours.

If you are affected, we will contact you by email to let you know that your usage at peak hours is excessive and is affecting other customers. The email will be sent to both your Tiscali email address and your contact email address (if different) and will contain simple advice on how to reduce your usage.

If your usage is still excessive, we will contact you again by email to ask you to reduce your sending and receiving of large files during peak hours. If your usage still remains excessive during peak hours, we will contact you a third time to advise you that we will be restricting your bandwidth during peak hours for the good of all other customers. This restriction will only apply during peak hours and there will be no restriction at other times of the day.

How can I manage my usage?

Simply ensure that any file sharing, sending and receiving of large file is done outside of peak hours.

What happens if you are affected by the Fair Usage Policy?

During peak hours, customers affected by the fair usage policy will share bandwidth with each other and will be separated from other customers. The amount of bandwidth available for affected customers to share, will be at least as much as for those customers unaffected by the policy.

The speed affected customers experience when downloading at peak hours will therefore depend on what these customers are doing. If they are all web-browsing and reading emails, they will experience normal broadband speed. If on the other hand they are using Peer to Peer or file sharing software they will experience slow broadband speed. Outside of peak hours, no restrictions will apply.

My point being nothing - I didn't write that. Eagle asked what fair usage is, and I can't answer that, so I copied what Tiscali wrote about it on their website, which might well be what a lot of other ISP's do aswell....

It makes sense in a way I guess.....

it's come across a bit worng that mate

if they are aren't going to drop you or charge you for going over the limits then why go through all this hassle and write up all these rules?

unless you awould still be paying for non broadband unles you were doing it over night?

If you download Netlimiter 2, you can monitor your own usage no big deal.

I used to have ADSl with Nildram, they had a 50GB fair usage policy, but it only applied during their peak hours (which were during the day). Nights and weekends were off peak and not subjected to monitoring. I did all my downloading at weekends. Never even got close to half of my usage limit.

They do 8MB now.

I switched to NTL cable. 10MB for £17.50 a month unlimited.

the tiscal fair usage policy is actually ok. from 6pm to 11pm you cant download massive files such as movies and porn. the rest off the day is ok so there is no problem really.

so you can use the net when your not at home then


hell thats like my pub having a happy hour at 10am on a tuesday,,,,,,, who the fuck would be able to take advantage of that unless your a housewife,,,,,,,,,, and then would you want your missus downloading that type of content when your at work


seems strange they charge that YET they dont give a discount when you dont use ANY bandwith that month

i never used my oc or 3 months but i still was expectec to pay the 35 quid a month


i dont even download anything either
