Since when has 91 been a ban? On a 60mph limit road possibly, but not on a Motorway. You would get 3 pts for 91.
According to the friendly officer that stopped me not so long ago, he said I would be reported to the Procurator Fiscal for 99.6mph in a 70. Was happy with that and took what came my way (6pts and £200 fine for the record).
The copper was a nice chap and informed me that anything over 94mph will be reported ot the Procurator Fiscal, anything under will be a 3pt penalty.
Back on topic, there was a case like this up in Inverness a while back where a boy was clocked at 136mph iirc in his Scooby, and he was adamant his car wouldn't do this as it was limited to 112mph in line with the normal imports.
He managed to prove that the limiter was still fitted and avoided any punishment last I heard. The eveidence was thrown out as being inaccurate.
All depends what you said your estimated speed was when you pulled over, if you said 70mph then it's your word against theres and in a case like this they need evidence to do you for it.
