Default MOT question

My wife has a little Ciroen Saxo, it failed its MOT last Friday and is booked in to have work carried out to fix it for the MOT on Monday 4th July......Is she ok to drive it about in this time regarding the law? Do cars flag up on the police systems as in no MOT as I know insurance and tax does, well on the proper police cars like the Omegas.

Interesting!

So even if it still has its old MOT, a fail means no driving?

Seems the more correct way of doing things

an MOT is only valid at time of test, the driver is responsible in keeping that vehicle road worthy during the time between tests. so knowing it's failed and then driving it till the cert runs out is deemed as you knowing it's not road worthy / legal

This is the best advise. At work we get people asking the question all the time when their car fails the mot and this is the exact answer we give them.

It's a bit of a grey area. Some say the old MOT is invalidated if the vehicle fails at a later date. Others say the old MOT still applies.

But as others said, you could get caught ( highly unlikely ) on the basis of the car having defects if stopped and checked and hence unroadworthy, which is nothing to do with the MOT which really is a worthless piece of paper in many cases.

You can take your vehicle away if your MOT certificate is still valid.
If your MOT has run out you can take your vehicle to:
have the failed defects fixed
a pre-arranged MOT test appointment
In both cases, your vehicle still needs to meet the minimum standards of roadworthiness at all times or you can be fined.
You can be fined up to £2,500, be banned from driving and get 3 penalty points for driving a vehicle in a dangerous condition.
On the Refusal of MOT Test Certificate it says
This document tells you that your vehicle has not been shown to meet the minimum legal requirements for the reason(s) detailed. If you intend to use your vehicle on the road you should have it repaired without delay and have it retested before the existing test validity expires.
I haven't seen anything to say that failing the test invalidates the current MOT. This suggests you can still drive the car but it would be considered unroadworthy if you were pulled over due to whatever reasons that caused it to fail the MOT, but it wouldn't be classed as not having an MOT.

Bit risky as the penalties for driving an unroadworthy vehicle are more than for driving without an MOT at all, but I think it won't flag up the systems the same way no MOT would
