motorcycle accident help?

Default motorcycle accident help?

Hello everyone, I just thought I would see what you all think about a crash I had on Tuesday, I was riding up a road (uphill) when a car reversed out of its drive quite fast and swung as if to face the direction I was facing and hit me with the nearside rear corner of the car!
He was still reversing when he hit me, and I was doing 20mph in a 20 zone so the impact was quite hard, I tried braking as hard as possible but before I knew it I had smashed into the car, I was wearing a highviz and my helmet is chrome red so I was very visible, and my bike is quite loud! He didn't admit liability however said he only saw me when I was a few feet from his car, and said he only looked both directions once, I saw his head as I was coming up to collide with the car and he wasn't looking back over his shoulder like he should have been, whilst reversing into oncoming traffic!
Id just like to hear some of your thoughts, if you want to know anything else just ask?
As for injury I have a cracked toe, scrapes/grazes, sore body and my neck/back feels pretty damn sore! I didn't even think of my neck whilst I was at the hospital as my toe was hurting the most, do you think I should visit the hospital again and maybe make a claim for whiplash? and do you think that it was him at fault? I most certainly think that he was!
One last thing, my insurance wants 60 quid legal fees, and they haven't really told me who they think was at fault! but my old man thinks I should just write to his insurance company and make a claim against him..

From what you have typed is that he reversed out of a drive and hit you. Pretty blatant he's at fault as he was coming out onto the road. In some case's when the road is of a certain limit you have to reverse into your driveway. I'd say he was at fault. Get a claim in. Pay the money to your insurance for legal cover because if he does not claim responsibility you could be out of pocket in the long run. Visit the docs every couple of weeks so the injury specialist can see a log in the future and to help with your claim.

sounds to me like he's at fault. hope everything works out ok.
