Default Advice needed

Was in a car crash today took my Rs out for a drive with I have spent £££ on. So I have come up to a round about in the outside lane gone straight across and a old woman in a Nissan micra has driven straight into my passenger door. She pushed me quite away. So we have stopped and they where full of apologies then a woman stops and says I was a boy racer who was obviously speeding and spoke to the old woman who was about 90 and said same thing to her and said she would be a Wittness. So I said that she didn't even see the accident and she just shrugged her shoulders. All the damage was to the front of the micra and all mine was the passenger door. I'm was not speeding at all it was hammering it down as most of you know escort Rs turbos understeer terrible in the rain so I was doing no more that 15mph. What I'm worried about is that this phantom witness says I'm a boy racer and I was speeding that ill loose everything so I just wanna double check all this. My insurance is with footman James so what are they like? Also how does it all work as I have cossie management n all sorts of tricks I don't wanna loose it all, will I get to keep my car and strip it and get paid out ECt any info would be brilliant cheers

Your questions should be answered by your insurer. Not by a bunch of random people who don't know the ins and out of your policy and are only being told one side of the story.

Dunno about losing the car , but she can't say shit about you speeding. She has no proof. A copper couldn't say you were speeding without a gun to prove it. No skid marks either if it was wet. Plus she has hit you! She should have been looking!

Although not a totally honest thing to do, as this so called witness didn't see the incident yet is willing to point blame at you through discrimination by stereotype, I'd get a friend (not relation) to act as a witness on your behalf, saying they'd seen the accident.

As said, not completely honest but neither is this so called other witness who could potentially fuck your claim.

Basic case law round abouts left lane exits 1 and 2 right hand lane exits 2 onwards youll win obviously not your fault

did you take any pictures at the time? that could be helpful to show who was at fault.

if the witness is lying, there's a chance both stories wont match up.

in fairness with damage being where it is and if your car has all mods declared you should be ok,

I have it in the back of my mind that accidents on islands often go 50/50 as proving who was in what lane etc is difficult to prove.

Picture will help and making sure your sketches to the insurance company where each car was will help and picture of road markings, lane etc so they have a clear idea of what went on.

Was she on the island or was she entering from another lane? If she has come onto the island and hit you as you crossed it then it should be clear cut as she has entered without checking and not given way.

Exactly! He was in front of her when she hit him! No way would anyone get away with seeing a car crossing the round about and dri ing straight smack into the side of it! It's clearly her fault! If he was speeding in the first place any normal person would hold back and let the hazard pass before entering over the line!

I hope to god you keep the car mate seriously! It really is shit having to rely on other drivers to keep you safe! But that's how it is. Nothing you could have done!

I had exactly the same about 8 years ago, I just stuck to my guns and pointed out the damage areas, her front, my door.

I won in the end although it took about 14 months ( big up to Barry@Greenlight for helping me out, they were superb )

was she already on the roundabout or too your left

if she was on the roundabout then it would appear you pulled out and she tee-boned you............ hence your fault

Only way it could be your fault is if you were in the wrong lane

Fight it and do not admit anything to anyone, blame it on her too the insurance company and they will sort it

Get pictures if it helps of where your car was placed in the road when she hit you

I wasn't aware footman james covered modded cars? I would maybe watch what you say to them if they aren't in fact fully declared already.

Sounds to me like it was completely her fault. As you were on the roundabout and she was joining she should have given way. Even if you were in the wrong lane (i know you've said you weren't) she cant just assume you are going to take the first exit (or whatever) and not go straight through. Still her fault.

People see (or hear) a car and see a young man driving it and jump to all sorts of conclusions.

As for the op if I were you mate go and spend £100 speaking to a solicitor as I'm going through serious shit right now because a woman drove into the back of us,has provided no evidence apart from verbal evidence and they are taking her side and despite me producing a 4 page report,photos of the area etc.
They have even now said that they are not prepared to consider a plea bargain,not that i want a plea bargain and its all our fault.
They are,pardon my French fucking wankers,I've lodged an official complaint and accused them of being unable to read,their fucking mongs and I'm doing what I should have done at the start,paying a solicitor to write a threatening letter and reporting them to the insurance ombudsmen.
This is my own fucking company as well!!!!

If she's straight t-boned you with damage to the front of her car and the nearside of yours I can't see there's possibly any kind of argument. Regardless of speed or what lane you were in (not saying you weren't in the corect lane) on entering a roundabout you give way to the right, therefore she must have pulled into oncoming traffic. Case closed.

happened to me years ago when i got my car bummed by someone while we were both getting onto a dual carriageway
4 years it dragged on for and then the county court fuckwit said it was my fault for going too slowly even though he admited to going to fast and shunting me

my insurance company said that if i wanted to procced then i would have to foot the bill and the cost of the claim if i lost as "there wasn't enough evidence to turn the decision around" :Wall:

cunts the lot of them when they claim to be "specialised insurance" but don't know fuck all

don't think so, it was way back in 1999 when i was insured by said company, and then the claim was made in 2004 "because the other driver moved house and no one could find him"

included in the costs was the interest owed because of the time scale

as said, cunts

i'm sure i can find the original thread given time, but it just goes to show that "evidence" submitted on the day of the court case (because my solicitor said it was ok to add it as they walked through the door) even though it has no direct bearing to the case, still fucks you because the judge believed the other guy could see through 50 foot worth of brick wall on the underpass

he said he was in the underpass as i was joining the overpass slip road and he could see me as soon as i turned off the main road onto the slip road, through the 50 foot of brick wall and concrete etc and "observed me for 200 yards before i pulled out in front of him because i had slowed down to 50 mph as i was aware there was a speed camera up ahead and the other car was only doing 40 so i had no option but to hit him"

and "there were no cars that stopped to act as witnesses" even though he then produced 2 old ladies as witnesses

and this is in court, in front of a judge, who seemed to have made up his mind before he'd even looked at any of the actual factual evidence placed before him

to the OP, do NOT let them take the car from your house "for assessment" because it won't come back to you in the same condition, if at all

I see it quite clear, you naturally have to give way to the right on a roundabout, your already on the roundabout going around shes not given way pulled out and collided with your car.

straight forward if ask me.

Speed bares very little impact in assessing blame for an accident in the eyes of an insurer.

Do not allow your vehicle out of your sight, allow acces to it to show you have nothing to hide but they go to it not take it away.

When you're all sorted go round the "witnesses" house and take a shit through her letterbox.

Sorry, didn't read properly. If you have salvage retention on your policy you will get to keep the car. If not you'll need to negotiate buying it back.

When my old 2i got twatted we were refused retention of the vehicle.

possession in 9/10th of the law

just tell the insurance company that you do not wish for the vehicle to be removed from your property until the cheque for it's value has been cleared and they normally won't spend MORE money sending someone to come and get it on the back of a recovery vehicle and wil come to a compromise

^ Did that with my 2i. Cheeky fuckers offered me £500. Refusing to let them take the car until the claim had been settled. Got a call once a week saying the insurers had instructed they collect it. Each time I said I was contesting the valuation and would not release the car as until I had accepted an offer it was still mine. After almost 6 months I got £2800 for the car

If she drive into you it is her fault.... especially if its the from of her car and the side of yours therefore it is her fault.... not yours. stick to your guns..... this happened to me a few years ago and after they gave me I was speeding etc to boy racer .... I explained they went across the double white lines into my path.... 100% their fault insurance decided!

Old woman driving a Micra, it had to be didn't it. As soon as you put someone over the age of 50 in a Micra they instantly lose all concept of coordination and turn in to a nervous crawling wreck.

For what it's worth mate as long as your insurance is all legit and declares all of your mods you should be ok as it sounds like she was totally at fault regardless of what this trumped up witness reckons she saw (or didn't).
