The car should not have passed the MOT which was issued last June, therefor whoever got the car MOT'ed back in June may not realise that he sold the car ilegally by selling with with a invalid MOT certificate. Jim is therefor fully entitled to return the car to the previous owner with a complete refund.
unfortunately, if you check with ministry of transport, complaints about validity of MOT can only be up to 3 months after issue of MOT certificate.
private sale is sold as seen-unless you can prove that the seller knew of faults-so unless hes took it for pre-MOT etc within the last 3 months and YOU have the failure sheet then you haven't got a pot to piss in i'm afraid.

to be honest as said any 18 year old car with 3 months MOT left to run surely needs scrutineering properly before ANY cash exchanges hands.

Well, maybe you're knew to MOTs but the rule is "on the day of the inspection", also theres the clause something like "a valid MOT certificate does not mean the car is safe" Rot can set in very quickly depending on where a car is stored or used. The strains of having a very low stiff car are also well documented. And can manifest themselves at any time.
gotta say this is my view too, I hope you can get it sorted, but reckon you have 2 hopes, and ones Bob

it was moted what 8 months ago so much can happen to a car of that age in 8 months just because people rush into things splashing cash without looking at things properly then when they find problems all this legal bollox comes out at the end of the day YOU SHOULD OF CHECKED THE CAR OVER BEFORE BUYING i just hope the seller isnt anthing like me cus if i was in his postion and you come round wanting refunds shit would hit the fan .

Get a better legal advisor! Getting under a car to have a look is the only marginally more difficult than looking in the boot.

No, not you

The ERST is a death trap full stop.

Just bought my Series 1. Totally checked every part of the car, went back 3 times to it, dealer was getting fed up with me but I knew it HAD to be right. Made the dealer MOT it at a neutral garage too - everthing was superb including the dealer.

I spent hours and hours going over my new purchase as it was a lot of money....

Best thing to do is to get it MOT'd again somewhere else for a second opinion, then get a local reputable garage to fix it and start enjoying it. From what I read it was a relatively cheap car for what it was (4.5K's worth for 3.7K) so spend the extra on getting it perfect and enjoy it.....

Both front inner wings cracked within 30cm of suspension mount (MOT failer)
*o/s/f "A" pillar Rusted
*o/s/f wing poor fit and loose
*Both outter sills Rusted (MOT failer)
*o/s/f front floor pan rusted (MOT failer)
*Dent in fuel tank (possibley leaking)

Engine side:

I agree. You have to prove that they knowingly and intentionally sold the car with faults without declaring them to you.

Maybe the previous owner was as naive as you, and had never checked underneath.

i dont know either of you so i am comletely impartial and unbiased but i cant see what all this is about, if you bought the car privately sold as seen its completely up to you to ensure what you are buyin is ok, and as for the mot, its worth nothing after 8 months, rot most certainly DOES set in inside that amount of time , theres no question about it, i have had cars mot'd and then a year later the fooka' s rotten here there and everywhere, thats just the way it happens.

the way i see this is

you bought the car, you didnt check it, it turns out to be rotten , its shit news but its your fault for not checking it, i really cannot see how you think that its any other way and the mot not being legal 8 months ago coz its rotten now is just ridiculous, bite the bullet mate , learn from your mistake and move on.

Bummer m8, I saw this car when it belonged to a guy in Haywards Heath about 4 months ago, I saw it advertised on Ebay and asked the guy if he would show me before it sold (i live about 5 mins away from him).
It looked in real good condition to me and i know the guy had spent a fair few quid on it including upgrading the front brakes to Willwood.
Also i believe that this particular Escort was a german one and therefore not rusted as much as other D reg's using metal from elsewhere!!

So if im honest and had i wanted a nice S2 i would have bought this car without giving it a thorough check as it looks so clean everywhere else and under the bonnet etc etc.

hopefully you will be able to get some cheaper quotes than £1500.00 and get it repaired properly you will have a decent S2!!

Things will look better in the morning.

Acutally cars can rust in a few months, my s2 had a restore done one it in 2002, fully resprayed. My car had not one mark of rust on it before xmas, went out to it yesterday and there is some bubbly occuring along the door just below the window also on the roof near the sun roof. And also a few specs of rust where the paint has been knocked of, ie door edge hitting fence. Yet it was ok 3 months ago.

I work with the law and know more about than you 2 brothers put together. Your only case is if you have a receipt signed by the guy saying that the car was in a1 condition and free from defects mentioned above. If you have this, you will need a fully qualified engineer or inspector to list the damage and how he belives it happened, this will cost between £100 and £1000 which you will have to pay upfront.

a legal explanation of sold as seen: A s2 is for sale in the paper of a private domestic sale, it comes with 1900cc conversion & uprated intercooler and 17" wheels. I am obviously no car expert so I take it to a vat registered mechanic, he informs me that the car is 1600cc, standard cooler and wheels are 16"`s.

I complain to trading standards who advise me to contact the individual first, he tells me piss of sold as seen. As I have a receipt and a copy of the add staing the car was sold with these parts, trading std`s advise me start proceedings in the small claims court.

Aside from all this how did you not spot an oil leak and a lose wing?
