Finally! Clamping, and toeing away, on private land, is now a criminal offence!

But what does the bit about parking tickets mean? I was under the impression that if you were issued a ticket by anyone other than the police or council, you could just ignore it and it wasn't enforceable? IE, park in a Euro Car Park run parking lot (many parking lots are "run" by NCP, ECP, etc, at supermarkets, local shopping area's, business/shopping parks etc), you just bin it, then bin the letter from them saying they'll take you to court, and eventually they leave you alone as the ticket cannot be tried in court - and that only tickets issued by the council and the police are able to be upheld in court?

private parking tickets have always been able to be taken to court but only as a civil case with the claiment in effect sueing you for damages for parking on thier land or breach of contract. Very few succeed as the level of damages is often zero and when they do succeed its usually something daft like the £1.20 parking fee for the hour that is upheld rather than the rediculous claims of hundreds of pounds.

they are now setting up a non-binding appeals service ie it holds no legal power whatsoever

The industry is pissed off because they wanted private parking tickets to be written into the law to give them more powers to enforce payment.

Riiiiiiiight - so even with this new ruling, can I still tell NCP and ECP etc to fuck off when they give me a parking ticket or not?

in the uk? get with it lads, its been banned in scotland since the early 90's. we look after our own.

you have to be careful who you clamp in NI or the clampers HQ might get blown up

I wonder if this is the same for debt collectors too? they are private organisations too.
