Deposit for car
i took a £100 deposit for my xr4x4tt. the price was agreed at £2000. man said he would keep giving me some every week until he either sold his car or it was paid in full. reluctantly i agreed. now 3 weeks later and no more money he says he is on short time and the price is too high for what he now describes as a project car, will i mot it etc?
i have told him its upto him if he still wants it or he can forget it. reasonable?
my question is am i obliged to return his deposit?
remember he has been umming and ahring about buying it for 2 months and looked at it three times with a fine toothcombe.

Nope keep the deposit and tell him that it will cover the cost of readvertising the car now that the old adverts and potential interested has expired.
Balance in full with 48 hours or he looses the deposit.
I had this with some bloke about 15 years ago, bought my car for £600, leaves £200 deposit and says he will pay the £400 balance the following Friday - he actually held his hands out for the keys and expected to take the car at that point lol. Friday comes and he says next week, I agree as I was still using it.
Next week he arrives and asks for another test drive? take him out and he says 'yes, i think i pay you less for car or i dont want it'
WTF! I replied 'you can either pay the £400 balance, or you can piss off and I keep your £200 for messing me around'.
He couldnt get the £400 balance out of his pocket fast enough.
Balance in full with 48 hours or he looses the deposit.

tbh i was reluctant to say yes when he offered to pay in bits, but he said every week. 3weeks later and i only have the deposit.

if you did you should really put 'non refundable' deposit
but if no receipt no money changed hands anyway

guy who i work with viewed a bmw z3, he left £500 deposit but then carried on viewing other cars, long story short he bought another and collected his deposit after 2 week.
in my eyes a deposit secures a car and should not be refundable, ie decide if you want the car or risk it being sold to somebody else.
personally i would tell him to jog on aswell

i havent heard anything from him since the txt about short time etc so i have sent him a message saying the car will be readvertised.
i spent a day removing and refitting the interior to remove the cd player and amps to make it cheaper for him, twat.
if anyone wants the car let me know.

ive taken a deposit numerous times, but ive always made it clear its non refundable if they back out. If you make it clear from the outset there isnt any grey area - i also give them a receipt for the deposit and put on there no refundable
in your case i would tell him to come up with the rest of the cash or lose the car & deposit

i had a guy send his mate (also my mate at the time) back to me asking for his money back for a mk2 fiesta he bought from me, 50000 miles 1 owner 12 months mot was £500 but his missus didnt like it, i actually pmsl when he asked and my mate told him id laugh and never do it, he insisted on trying though lol

For me deposits are always no refundable no matter how large or small. If the buyer wants it back, tell them you can pay £2 back per week over 10 months.

Deposit is 100% non refundable - Best to make sure that you have a buyer sign to agree this too.
I have taken a £500 deposit on the E39 and made it crystal clear that it is non refundable - Below is a copy of the receipt I made 2 copies of (one for the buyer and one for myself) with him signing to agree to the terms of the deposit on a standard form that I adjust to be vehicle specific whenever I sell a car on.
If he pulls out then it's £500 towards my costs of storage, re-advertising, lost interest etc etc and the buyer has agreed to this verbally before signing after reading the receipt

One thing i'd add on that letter is to state a time period the deposit is valid for, otherwise someone could keep you hanging on. Ask the seller when he's coming for the car and i'll then usually add another week on to give him time if something happens.
End of the day, you can't be waiting around for a month based on some guy's £100 deposit.

I'd say non refundable. Whenever I've bought a car, i've never done so without either having the money sitting in the bank, or knowing for sure that the funds would be in the bank, cleared in time to purchase it. Then, and only then, will I go to look and leave a deposit, knowing that its just a case of arranging to get the funds out and pick the car up.
A few years ago, 2004, when I bought my ST24 estate, I went to look at the car on a Tuesday, knowing the cheque I paid in the bank would be cleared for the Friday. I done the usual going over the car, out for a test drive etc, so went to see the salesman to talk money. The car was up for £5k, 99 T reg, 75k, etc, so after explaining I wanted it, money would be clear by Friday and I'd come down on the Saturday to pay and collect it, it came to the subject of a deposit. This was when i found I'd left my wallet and cards at home, car was in Maldon, I'd come from Bury St Eds, so couldn't just pop home and get it, and all I had on me was £10, and he agreed to take the £10 as a deposit, lol, the lowest deposit I'd ever paid. But like he said, a deposit is a deposit, no matter how much it is, and he agreed to keep it until the Saturday. I went to collect it on the Saturday, paid what we'd agreed on, and all was well.
