MOT testers, Is this a fail? Bent chasiss

Default MOT testers, Is this a fail? Bent chasiss

This is a picture of a N/S chasiss leg on an 04 reg nissan micra,

The leg has a crease down it basicly the whole length on the leg with that damage at the front. Is it a pass?

Im not planing to mot it but it has passed an MOT like it. Just want opionons.

i wpuld off said fail looks like it split to me too?

if it's split then i would have assumed it's a fail mate

probably worth waiting for one of the testers to come on and have a look the likes of matt baxter etc or that fella who did a refresher course the other week

is it within 30cm of suspension, steering or seat belt mountings?

if its not, its a pass and advise

i think they have revised alot of the manual especially on corrosion. as before as above, not within something important pass and advise, but now things like front crossmembers/inner wing sections all are included as load bearing points on a monocouque chassis.

i think! - i don't have a manual to hand so can't check.
although obviously the above isn't corrosion, it's a fracture which i think would be failure!

Also if not within a prescribed area, Damage which adversely affects braking or steering by severely reducing the strength or continuity of a main load bearing structural member!!!

Prescribed areas are within 30 cm of either a steering, braking, suspension and seat belt fixing/mounting points!!! as someone has said!

So, could the tester who passed that get into trouble with VOSA?

This guy got a 50 week jail sentence, suspended for a year, 150 hours unpaid work, £1000 costs and has been banned from doing tests.

Glad to see they(vosa) do take it seriously.
Looking at the damage though the exposed metal is nice and shiny so not been like that long, maybe not at time it was tested ?
