Paid an item by "Gift" on Paypal, never received!

Default Paid an item by "Gift" on Paypal, never received!

Ok, first off, it wasnt on this forum, it was another site

Basically, i bought an Irmscher splitter for my corsa off a corsa site on 23rd July. Hadnt saw the item a few days later so i PM'd the seller, he said he had forgotten about it and would post it out.

A week later, i PM'd him again to which he had told me he had went to Egypt for 2 weeks on holiday and was sorry, hed post it out when he came back. Hes been back now for 1 and a half weeks and still not sent the item. Its now nearly 5 weeks since i paid for it!!

I have his address and got his home phone number and have called him on Thursday there, he apologised and said hed send it out Saturday. Still nothing through the post!!

What can i do, as i stupidly paid it as a gift through Paypal

Should i call him again and waste my time, or is it a matter for the police?

Or anyone stay in Rainham, Gillingham that wants to give him a chap at the door?

Your screwed unless you can visit him, sending a Paypal gift is like sending money in an envelope, there is no come back, the police will do nothing mate

Did you pay via Credit Card as they have protection for this sort of thing. I would contact Paypal either way and explain the situation, see what they say.

I never send money as a gift for that reason, and for the reason that when you send as a gift it charges you to do so if you are paying by card, so instead if someone wants 200 as a gift, i send them 208 not as a gift (or whatever the actual amount comes out at)
Doesnt help you much though of course, other than for next time.

Paypal will have NO interest in helping you if you tell them that you were deliberately stealing their hard earned money from them by pretending something was a gift when it was in fact a payment, the only reaction you are likely to get is them freezing your account

He has sent a gift, he has no comeback with his credit card company I suspect, he would have if he sent it as a payment of course, but as a gift I dont see what the credit card company can do as they would need evidence of fraudulent behaviour or faulty goods etc and how can you have any of those things when you have given someone some money as a gift?

Its irrelevant to the cc company how it was paid for and if it was sent as a gift or not. Thats a dispute with Paypal, not the cc company.

No chance, paypal will say FU sent as a gift= no comeback. Just take a trip to his house and ask for the money back!!!

When I did a paypal claimback on my credit card they wanted to see details of the transaction and wanted to know in what way I didnt get what I paid for.
When what you paid for is a gift, how can you give details of what you didnt receive in return?

Only problem is he stays 433 miles away, 7 and a half hours drive

Its only Ł125 but its not the money thats the problem, its the fact hes ripping the piss!

As far as Paypal is concerned your paying as a "Gift" as far as the cc company is concerned you paid for an item and used the "Gift" function to pay the fees as a good gesture to the buyer. You will have proof saying what your buying and that the person confirmed you will be paying through Paypal as a "Gift" to cover costs. This is irrelevant to the cc company imo. Did your claim get rejected by your cc company as your paid by "Gift"?

I paid for a PS3 a year or so ago through paypal on my credit card, never recieved it and filed a chargeback with capital one, got the money back straight away, BUT paypal closed my account. At the time the maximum claim through paypal was Ł150, and I had paid well over Ł200. fucking cocks!

I didnt pay as a gift, as Ive already mentioned I never do that unless its to someone I trust, so no my claim didnt get rejected as it was all above board.

communication between you and the person you purchased it from is evidence if the Police or cc require it.. I had an engine I purchased for Ł100. Paid the CASH into the persons bank, had NO evidence why I was paying the money in and what for, but the person is now paying me back through the Courts. So what does it matter how you paid for something, the person has still taken your money by fraud!

Fletch, im not sure how seriously a forum PM would be taken by a credit card company, as its SO difficult for them to verify as its so easy to fake, but maybe they would just take your word for it, i guess he can only try and see what happens!

I doubt they would use it tbh, but atleast you have the communication to show them. I had text messages when I had that problem which I gave to the Police. Any help to prove your case is good imo.
