Default Advice needed...dog's killed next doors cat

Next doors cat kept shitting in my garden and the dog has nearly had it loads of times but has always been on his lead so he's never actually caught it but the dumb animal keeps coming back. This time he shot out of the door and got it...and before any one says it, it wasn't intentional, I've got to tell my neighbour their pets dead when they come back off their holiday which I'm really not looking forward to

Not sure where I stand, he's soft as shit with people but can be unpredictable with other dogs at times but that's only when they run up to him, most he ignores.

Just wondering if anyone else has been in this situation

Dispose of the cat, say nowt. If they ask it must have been ran over somewhere while its been out looking for gardens to shit in.

I would tell them you found the cat on the road side. They can then do what they wish with their pet and it won't bring a neighbourhood battle into play.

Think of the positive side. At least that means there is less cat shit in your garden.

If you can, don't say nothing as you will only get the blame, even though the cat shouldn't have been there.

He chased it out of the garden across the road, a few people saw it. I wish I could say it was an accident as it would be better for next doors kids to handle. Also my neighbour is the kind of bloke that would put poison in my garden for the dog

The police have no grounds for action as the dog is not in a public place and it has been argued in the past it is in a dogs nature to kill and wound small animals.

Civil action is a possibility however.

Think thats a good idea but could you tell the cat had been killed by a dog and not hit by a car? thats the only downfall with that plan

Most laws regarding dogs refer to either fighting or their behavior towards people. If the attack had happened on your own private property then there is no case whatsoever. As it happened outside of your property in a public place you are quite likey to be charged with having an out of control dog.
And the owners of said dead cat are within their rights to take out a civil action against you. It all depends whether you or one of the witnesses reports it.

If I knew your address I'd personally report you now.

I've spoken to the law regarding it explaining the situation and they said it's not a matter for them so please feel free to wind your neck in. I've already said it wasn't intentional but you're acting as if I've set my dog on it on purpose...

I never said anywhere you did it on purpose. If it had happened on your own property it wouldn't be a problem.

But because your dog left your private property and entered a public space it leaves you liable. Until a witness or the owner make an official complaint there's not a lot the law can do.

I would hope as a RESPONSIBLE dog owner you do the right thing and tell the owner of the cat what happened.

Same thing happened to my mums cat a few years ago, this dog was always getting let out by the owners to run around causing havock and chasing everything.It was out one night caught and killed the cat owners were fu**ing wankers and did nothing about it abit of fisty cuffs followed but nothing ever happend with the dog.Most people might say its just a cat but this was a vicous bugger and i really think had it had the chance it would have bit a kid.
Sounds to me like you did nothing wrong if the cat is stupid enough to keep coming into your garden knowing the dog is there then fair play.

That's a great shame. Anyone who thinks you shouldn't tell them is an evil bastard. You'd see them put flyers up and what not? Go out lookig for there cat hoping it returns. When all along the person who's dog killed it says nothing? Great idea...

The best thing you can do is be honest, and hope they're not a bit nuts and kill your dog, or attempt too. I'm sure they won't? Offer to buy them a kitten, and be as nice about it as possible.

Hmm ive got a simaler situation, next doors cat is always in our garden now winston our 2 yr old boxer hates cats like proper style!! turns in to a loony when he evn smells one near by, now their cats their world but is really old and can hardly run!! a few times its nearly not got up on fence when I let him out as cats about 14!!

but its life, not great but seriously honesty is the best policy and all that crap!!

Id personally if no one seen it just bin it, but as people seen it just do the decent thing and tell them.

Benni, i agree not telling them anything is pure evil, but i think telling them them the dog next door( that they possibly see everyday) ate it would make them feel really shit etc, thats why i thought the reply above about saying you found it on the road was better, at least that way they know its something that could have happened anyday to any cat and also was probably a quick death, instead of being mauled to death by your next door neighbours dog.

Just my 2 cents

Responsible in as much as an incident occured and he informed the rozzers......

I ain't gonna speculate on the old 'what if it was a child' though, dogs react to cats which I do appreciate.
