Default mobile contracts where do i stand..

right short story i went over to vodafone from O2 and in the 1st 3 months my 5800 went wrong 3 times so they agreed to upgrade me to a N97 which went more tits up than the 1st phone and after another 3 brakedowns they sent me a new N97 last week and guess what... its fookin playing up again

can i demand another make of phone but vodafone say my insurance is with nokia not them

i realy dont want another yr and a bit constantly taking it to be repaired

anyone know what to do

Quote the Sale of Goods Act, which says goods supplied must be of "merchantable quality".

Your contract is with the shop, not the phone manufacturer. If the shop want to take it up with Nokia they are free to do so but that is not your concern - or problem.
Don't know if you can demand another make, but I would think you have a case to cancel the contract given the problems so far.

Nobody actually works for Vodafone ( or any other mobile company ) they just attend the place of work , talk utter shit to you to sell you a contract and then minse about all day with a fucking blank look on there face

I hat phone shops as they tell you one thing but when you have any problems what so ever they just dont want to know
