Default Anyone been through a boundry dispute with neighbour?

has anyone been through one?

moved into a house last month and found nextdoor is being a t1t thay have built a fence to which i think is too far over. now when i got the land reg info and plan etc when i was buying the house it showed the boundrys but had no exact size of the plot on it that i can remember. i want to find out what size my plot/garden should actually be, is there a way?

the land registry filed plan will be to scale, so you have to work it out. Depending on how long ago the neighbour moved the fence depends on whether (even if it is too far over) you will get any land back.

what so its ok to take a fence down and put it up further over and there is nothing i can do? surley in a loose sense its stealing!

Your deeds should have the plan of the bounderies. Probably find them with the Mortgage company or the solicitors you used when you bought the house mind have them.

If the fence is on the wrong place then i think the neighbour should cover the costs to remove it and reinstate it to the correct boundery

How much land have they 'stolen'? If it's a tiny bit and it's a principle issue, then consider if it's worth fighting. Do you really want your neighbours as enemies?

Whatever you do, talk to them before you get anyone else involved.

depends on how much land they have taken.

Speak to them if significant and say your not pleased at the fence encrouching on your land and could you guys sort something between yourselves.

If they are a tit abit it, then speak to land registry and get some advice.

plenty of disputes with neighbours, but you have to ask yourself a few things first before you get all upset about it

find the deeds first and establish what's what

if you have a mortgage, tell the provider what's happening

they may be inclined to take matters into their own hands when they find out that they are giving you money for something which shuld rightly be theres if you can't pay it back, plus they can afford more expensive lawyers than you or your neighbour

consider talking to the neighbours, but if you get a frosty reception remember that you've just moved there and you "think" they've put the fence in the wrong place doesn't necesarily mean that they "have" to move it if you are right

once you have figured out your best course of action, without actually actioning it or talking to the neighbours, go here and ask some experts

Firstly find out for sure what is yours and if they are doing wrong.

Don't forget that the fence and fence posts shouldn't even be up the centre line of the divide between you and them, ALL the fence must ALL be on their property.
