hello guys i was wondering if any one has been in the same predicament as me.just left my mrs after seven years.we bought a house together which she put down £70000 and then mortgaged the rest.we didnt put my name down on the morgage as she had a spotless credit rating and was just easier if we left it like that.now just found out there is no such thing as common law husband and shit im bricking it put shit loads into that house.now she aint no bitch and the split was mutual so all is good and she has never told a lie in her life so all is good.just wanted to know if any of you guys have been in same predicament as me and how you got on as far as the law stands before i start spending loads on solicitors and getting no where

get a VERY good solicitor and get professional advice asap - and no matter how 'nice' she may be, once money is involved it becomes a whole new ball game... experience talking

Mate unless you have recipts and such for the monies you have "put" into the property your fucked, only if you can prove spending on the house will you have any leverage. Other than that sort it mutually and hopefully you will get something but i suspect you will bbe leaving with fuck all....

firstly get proper legal advice quickly.
secondly, the nicest person in the world will turn into a nasty evil piece of work when summs of cash are involved - do not be niave to this.
If you have both been paying into the mortgage monthly and can prove it, then you may be able to claim 50% of the equity in the property less the 7k she put in.

oops, miss read the 70k lol
still the same principle applies, if it was 100k when bought for example,and 70k was put down, then a 30k mortgage will have been taken out.
So from the value of the house now, the mortage remainder will have to be subtracted, plus the deposit, leaving if anything the equity, and it is this IF he has been paying half to the mortgage that he has a claim to.
He is not entitled to any of the 70k imo - was never his.
