Default Speeding

The bride to be has got done by a gatso 50 in a 30... I know have given he a rollocking. Funny thing is she only does between 1000 to 2000 mile a year and has a clean license of 10 years. Last year her Ka did 1180mile between MOTs!

Received the NIP etc.

Whats the score in terms of the evidence?

Should she:

A. Take it on the chin and accept the 3No points and 60 quid fine

or

B. Write back and ask for the evidence etc.

Anyone else had one lately etc and or done option B

Take it on the chin, If you go against and fail it will only end in tears. Like double the points and fine. 3 points is fook all on a clean license.

You could challenge it under section 2 of PACE as you weren't cautioned prior to giving the evidence against yourself (filling out the NIP). As you weren't cautioned the evidence of the NIP is inadmissable in court. You do need to complete the NIP though to fulfill your requirements under section 172.

This is a grey area and any loophole that was there may well have been closed

She was speeding she got caught end off. You speed you run the risk.

On another note 50 in a 30 Honeslty! i could understand if it was 33mph of something. But 50 is dangerous in a 30 end of.

Break the law pay the fine, clean license for 10years ect means nothing tbh.

Is it not a possibility she could be looking at more than 3 points for 50mph in a 30mph?

I wouldnt want to go to court for 50 in a 30!!! Youll almost certainly end up worse off than the NIP.

Take the pionts and fine as said if you contest it you may end up with a bigger fine or more points most insurance companys aint too bothered about the first endorsement for sp30's so it wont affect here insurance to much if any

For 50 in a 30, you're not going to do better than 3pts and Ł60. That's a result. Could have been done for worse than that.

If, however, you really do want to "get away with it", there is another way, but I won't be posting that on a public forum...

I agree with you entirely however the section of road in question is not built up and the speed change is quite dramatic

I had one recently I was doing 38 in a 30, was going to take it on the chin but got offered the speed awareness course for Ł60, which I did on Friday just gone. I must say i'm now very aware of my speed and would recommend on everyone going on one!

You can request the photos online fella, thats what I did and recieved them in a few days

Nope, they must send the NIP within 14 days of the date of the offence. And them saying we did post it honest M'lud is good enough in court

if its only 3 points and Ł60 id take it.

are you sure there is no chance of going to court? as that speed would usually mean so

i got 5 points and Ł190 fine for 50 in a 30 btw

so all 30mph roads are dangerous are they?

i was caught on a duel carrageway in weston super mare, pulled out of a roundabout in traffic so booted it etc only to see a camera van. thought to myself, its ok, i was only doing 50...

little did i know until about 2 weeks later it was a cunting 30!

So you booted it in a 30 and got caught. Maybe if you are unsure on the area you should pay more attention to speed signs. some 30zones may seem odd but they are there for a reason, such as high accident rates or deadly junctions.

I'll hold my hands up. I'm a habitual speeder. I don't think I've ever done a journey (weather dependent) without exceeding the speed limit. At least I'm honest about it

I will admit in places i do make "progression" but i never speed in a 30. and if i am unsure of the speed in a area i look for the signs of if theres street lamps it probably going to be a 40 or less.

yes, i also was back in the area and did indeed have a look for a sign.

turns out that the only 30mph sign i would have passed was infact about 200 yards PAST where the cunt in the camera was.

if you drive a car, its a fact of life that at some point in your life you are going to exceed the speed limit, if say you never have they your lying.

i did not try to contest it, i done it i took the punishment. not disputing that one.

i now take preventive measures to make sure that i am not caught by some tosser in a van, like the lack of front numberplate on my vehicle...

Would just like to clarify it was 50 in a 40 so me bad, sorry folks.

In line with the above statement, she has decided to take 'em. Her first points after 10 years of driving. Her own words 'Well I was actually speeding'

Moral of the episode - If you speed like 99% of the UK population, be clever and dont get caught!

Cant believe I have driven for only a few months more that her, so over 10 years, Im the one who has had 'so called performance vehicles' and my license is still clean (Says the man touching a wooden table!)

For the last 5 years or so have done on average 50k a year so quite proud of it

Not having a go, but all these people saying 'take it on the chin' are part of the reason why there are so many cameras in the first place and why they plan to increase the numbers massively over the next few years or so.

Now if you want to accept it then fine, but at least make them work a bit for their money. Its not an offence to question it, so at least ask for photo's and/or calibration certs etc and try and prolong the process. If everyone did this, then they it may make a difference you never know.

All in my opinion of course.

To be honest, touch wood, ive never been caught for speeding. Im not a big speeder, but obviously i do speed on occasions like 99% of us and i find it funny when people say they NEVER speed or NEVER have.

been caught once in 16 years of driving

cop was leaning over the crash barrier on a slip road that joined the one i was on A5

the traffic was nose to tail he pulled me over at the lights and said i was doing 60 in a 30 . i thought since when has this bit been a 30 as i thought it was a 40 and i decided to contest it in court BIG MISTAKE.

the judge wasn`t interested in what i had to say
as the cop made it sound like i was on a school road not a dual carrigeway .

so i got 450 in fines and 6 points for my trouble and a telling off from the judge
and 2 weeks to pay or i was off to jail .i was broke i had to borrow money off my mates mum on the final day when i went to pay they had allready issued the warrent for my arrest c**tz .

so my advice for all its worth is to pay wish i had

As said it must be posted within 14 days, not received.
The refference to SECTION 172 of the ROAD TRAFFIC ACT 1988, doesn't apply UNTIL a offence has been established, but few people know that, failing to satisfy that a crime has been commited, to the court to start with has been used as a get out.
I received a NIP on 12/12/08, based on the evidence of a camera operator!!, NIP can ONLY be issued on the evidence of a POLICE OFFICER, anything less is hearsay.
The reason why all pictures of speeding must be watched and agreed with by plod before issuing NIP.
The sent me a NIP and asked me who wasa driving the car(my car) at the time, I told them to FO until they have sent me PHOTGRAPHIC evidence of any alleged offence before I would comply with section 172, I am still waiting, mind you the last 5 times I am still waiting and some are over 8 years ago.

If that as the case fudgey the road you were on wasn't a 30

There are no repeater signs on 30mph at all therefore if there was a sign it would of been a commencement sign and the start of the 30mph limit - god I actually learnt something in that speed awareness course!!

Actually if there is a system of street lights in operation then the limit is 30mph unless otherwise signposted. 30mph limits do not require repeaters.

The road my mum lives on is now a 30mph limit after some of the newer residents kicked off (was a 40). Cars always do 40-50 even 60mph along there. The only accidents down there are people not paying attention to stopped cars. In fact the last accident had a guy writing to the paper complaining about speed after his daughter had an accident outside the house. Had the dappy bint not turned straight across the path of an oncoming car it wouldn't have happened

you wanna learn your hazard perspection and thoery.

If there are street lights and no signs to state the road speed then its 30mph not 40 or less.

Can't belive all the shitty comment's in this topic.

Just take it on the chin dude, everyone brakes the law in some way and no-one is perfect, i know 12 roads in notts way that are 30MPH and most drive at 40-50 and its a safe road...
