Wrote my rs off!! VAN DRIVERS
hi guys up i finally got my car up to 300bhp went out on friday was going like a dream was going down lingfield road in east grinstead with parked cars on the side of the road my right of way a car came towards me didnt let me past so i got forced up on o the kerb heard my engine thump the path thought crap came back down the path to then have a van pull out in front of me i beeped my horn and flashed yet he kept driving as though i wasnt even there.

lol ye im thinking about going garuda i think there called, with all the rear wheel drive ones lol but i duno just miss it so much you know.
i hit his front passenger side wheel snapped all his wish bone and bent all his suspension up

Hope yur claiming on HIS insurance. Don't let the fucker try and stiff you like they tried to do with my brother. He was hit in his FRST and the cheecky foos said write off and sent a cheque for £1200. After a few phone calls and letters the car was repaired in full at their expense

shouldnt be any problem with insurance and ye gonna try claiming off of his insurance ye, thing is mate i dont want them to take the car because if i sell it in bits ill get a hell of alot more in parts, the car isnt repairable as all the chassic is all bent the pillars are bent the roof under neath the car its got a big crack going across it where the car took all the impact at least it did its job could have been alot worse.

i think my insurance says that they MIGHT want to take it but its a decision when the guys come out to look at it, if they do then i can still buy it off them for how ever much but even if i do in parts ill make my money back,i think also i could be wrong but i think that they say we'll give you x amount for the car and i think im aloud to turn it down.

Indeed mate. My XR2i was twatted by some gommo cunt and w were offered £500. I got the final offer to £2400. Car was still a write off though as it bent the beam pick ups and twisted things . Had a bit of experience dealing with wanky insurance

If you go through HIS insurance, then they cannot legally take the vehicle off you unless it is categorised a Cat B. If Cat C, this means they agree a payout with you and then leave you with the remains to dispose of as you are not the policyholder, you are a third-party. The vehicle DOES remain your property. It works easier though if the vehicle is left @ your home, rather than taken to an approved repairer.
If it ends up CAT B, then they are allowed to remove it for you as the vehicle is not allowed back on the road. You can request though for them to withold the payment cheque until you can provide a certificate of destruction. That basically means that you have taken anything of value off the car, then arranged for a dismantler/crusher to take it away, who will provide you with the approporiate certificate as long as you provide the logbook, VIN plates, etc... with the shell.
Once you send the form off, they release the cheque to you.
Hope this helps. Mick (with the white Sierra Estate 4x4 24V Cossie) had a similar thing with his one when it died. No other parties involved though, they just witheld the cheque until the cert. was provided.

lol i pay £2000 a year for insurance and the car has a 2.1 zvh conversion but with insurance i included alloys t34 turbo suspension and pistons and gearbox lol, kelv where do you live then mate?? it was the turning after then prince of wales pub going towards east grinstead.
the car was £4000 so no the insurance isnt more lol. i got a moddified mk4 fiesta im thinking about maybe doing an engine conversion with the rs engine in to the fiesta lol should be abit of fun i think.

out of intrest is that a pic of your rs in your display bar? the pic of the engine. correct me if im wrong but you say its 300bhp but im prity sure i can see MFI

For whatever reason, he didn't see you at all so he couldn't have done anything about it.
Don't bother using your horn, or flashing your lights, spend the same time carrying out avoiding action i.e braking steering away from where you think the other vehicle is going to stop etc. Assume the other vehicle hasn't seen you and isn't going to do anything about it.
The reason is, the other vehicle has to;
Hear your warning,
See where the warning is coming from,
Decide what to do,
Actually do it, And do the correct action,
Before he/she hits or gets hit by you.
All the above takes time whilst you are travelling towards them
You have more time to do something about it.
I'll tell you later how long I've been driving and how many times I've been hit, if you don't think the above is helpful.

Shame mate, looked a nice car!
This may cause you a problem with the insurance though. By the sounds of it the van driver looked to see if anything was coming and if you weren't actually on the road (but on the path/half on path), then he obviously wouldnt have seen you properly if this was the case. Unfortunate that you were forced onto the path but its 2 different incidents really.
Sounds like it may be a 50/50 if its not a clear cut case, as it doesnt seem to be clear cut, going by what you said mate.
Did anyone admit responsibility at the scene?

when i had mine written off the insurance company allowed me to go down to the storage yard to remove any parts i wanted to keep with no effecting the settlement figure.

well i travelled for around 10m bit more on the road i braked as hard as poss wheels locked up so i had to do pump braking i also swerved. i went back to the scene today to find half my car still sitting on the side of the road lol, and all the path chewwed up from where my sub scrapped along the ground,
the car at the moment is in my garage at home yes i didnt want to start paying for compound prices lol like £50 a day or something stupid.
the engine in my car is the 2.1 zvh engine, so its capable of 300bhp i didnt want to push it anymore as the car was a bitch to drive anyway and considering i was driving it every day it made it even worse but hey ho fun whilst it lasted.
the guy in the van did say he pulled out apparently but also said that apparently i was doing 150mph but i wasnt cause i had already been on the path from having to swerve around the veichle before and second that road i wouldnt even dare breaking the limit down there because of what type of road it is, when i spoke to the police officers on scene they did say that iot was obvious what happened i asked what and they just said "its simple he pulled out in front of you" my insurance also said that i have a pretty good change to winning the case.
the viewer people are coming out next week sometime i tried to open bonnet to see if it wouldnt open and it didnt

you/him were deffo doing more than 30mph to do that damage! if you had to let on and off the brakes you obviously had time to see him but were travelling too fast to do anything about it...
