Rear arches rub. will it fail its mot?

Rear arches rub. will it fail its mot?
When i sit on the back of my car the inner lip catches on the tire before it reaches the bump stops. Iv been reading up on this site http://www.motuk.co.uk/manual_240.htm
Reading this does it mean that the suspention has to be worn for them to fail it on rubbing? As Its gonna be a nightmare to make it so i wont rub at all.
I Might even have to get adjustable tie rods to stop this due to where it is rubbing on the arches.
