Default Track Day Accidents ?

As a driver, if you offer passenger lifts to those who ask, where would you stand if you rapped it n the passenger got hurt ?
Could they sue you?

passengers and drivers sign a disclaimer at the "breifing" session which excludes the track and its owners of all liability.

Not sure about the liability of the driver - best ask Mike and Chip about that one

I'm sure at a public event for anything like that you need liability insurance. Discalimers ain't worth a wank in Court - look at all the pre-nup's signed and all the women who take their multi millionaire ex husbands to the cleaners...............always a way round it.

Be mad to have no insurance, people can still claim from you if you're at fault in a crash.

Relying on disclaimers isn't a good idea either.

If you've no insurance, and fuck someone up, you could be left paying for the rest of your life for their treatment, loss of earnings, care, etc etc.

Chance you take, can't see anyone thinking it's worth it.

Yeah....did they sue ? A disclaimer is a legal requirement mate, you have to sign it but it protects the organisers more than the driver. It's up to you lot but if you take the general public on track without any cover specifically to look after YOU in the event of an accident you need your head read. Fucked if I'd put myself and my house at risk for it.

TBH someone like Porkie or Martin Hadland may be the best to answer this but I'd be flabbergasted if neither or either never had any cover specific to passengers if taking people round. If it's a mate and you spin that's one thing, but having a serious accident with a member of the public in the car is entirely another. Even having a mate in the car - you'd soon find out how good a mate they are if you stack it, put them in a wheelchair and they want compensation. If there's no insurance to cover it, whose door will he go knocking on ?

i will make a document up and get my "mates"/ "passengers" to sign saying, in the event of an accident, you CANT claim,

even if limbs or loss of earnings


are you saying if i did that, they can still claim?

As I see it, if you have a passenger in the car you'd be off your rocker to NOT have insurance to cover that person in the event of an accident. You may find the organisers have insurance that covers this in the event of an accident, and that may cover you. Ask ! My point being is you must have some kind of insurance in place, somehow, to cover you and any passengers.

The point I'm making to you guys is make sure you're arse is covered, makes no odds to me if you have insurance or not as it won't affect me. But it may well affect you. i understand your theory behind it all,

but as far i see it, most of it, applies to "normal" road driving, not track.

i'm not saying your wrong, but i also dont agree

as i said, i'm looking to puchase track insurance for cart damages, (£50 a track day) and it may well include someone claiming off me, but i not going out to get that cover

anyhow.

i'm off out now, in my insured car on public road

Essentially Stuart is correct, and it is even MORE necessary if the passenger is paying for the ride, be it for charity or anything else.

when we hire out rally cars we have to sign to say that if we have a serious accident and injure either the driver of teh navigator, that there is no responsibility of the cars owners
