Default What is the law on neighbours noise levels?? HELP Needed...

I've forgotten what time they are alowed to play music or bang until is it 10pm? Can anyone tell me what the laws are and maybe post some decent links?

These cunts have been banging, drilling and playing shit almost 3 days solid.

Mr. Les paul wants to play. (and nothing argues with him).

be a man,go round and have a (quiet )word mate ,my neighbour was doing it(parties every fri sat ) and music blaring middle of the week ,my young lad couldnt hear the telly on a tuesday eve ,i lost it been nice as pie ever since

its 11pm, flatmate got a asbo for playing music too loud. its a friday night alot of people work hard all week and like to let their hairdown on the weekend, im sure youve done it before?

If it does carry on tho, just go have a word. no need to break his hip or call the police

Been there and ANYONE are allowed to maintain there property or vehicles, lawn mowers, chainsaws, etc etc. between the hours of 7 am and 11pm, THAT is the law , believe me we've been there! after that complain or twat the cunt lol.

then after the curfew the annoyance must be over 77db (c weighted) within your living space or it is not classed as a nusiance...

One of our Fire Alarms failed its HMO test because it didn't generate 75db at the bedhead - trust me - if someone is allowed to put 77db into your home before they are causing a nuisance, the only escape will be cutting off your own head!!!!

The police told me you're allowed to play music at anytime as loud as you want. Not sure whether this is true?

Police wont be interested as we dont have any powers to remove the equipment. This is a job for the envorimental health officers as they do have the power to remove equipment. Police only standby to prevent a breach of the peace

the law commented to us ..

noise is interpreted as what type it is, and what effect it has on you and your family having to put up with the noise..
different volums can upset people differently ...

the interpretation of how you create noise is not governed by any time limits.

so .. if its pissing you off first ask them to be a bit more considerate, then enviromental health at the local council.
they should do something about it...

remember this though,

IF you go to the enviromental people and make a complaint, IF/WHEN you come to sell your house you must by law tell the new owners before they buy it about the noisy neighbours and that you have made a complaint about them to the EH people.

It would be in your best interest to have a word with them instead.

In Scotland, the legislation is the "Anti-Social Behavior (Scotland) Act 2004" - no doubt England has similar/identical rules.

The guidelines here state:
Noise nuisance (part 5)

Continuous noise nuisance from a few people can create misery for the rest of the people living in the area. Part 5 of the Act gives local authorities extra powers to deal with noise nuisance quickly.

* Local authorities can apply noise controls to specific areas and at specific times. If necessary, the authority can apply the conditions 24 hours a day, seven days a week.
* Officers of the local authority, or the police, have the power to investigate any noise complaints. Scottish Ministers will set the maximum levels of noise allowed and the approved measuring devices in regulations.
* If an officer of the local authority considers that the noise coming from someone's home is more than, or may have been more than, the noise level allowed, they may issue a warning notice.
* If noise continues after this warning notice has been served, a fixed penalty notice of £100 can be issued. If this penalty is paid, no further action will be taken. However, if the fine is not paid within 28 days, local authorities will proceed with prosecution through the procurator fiscals office. Local authorities keep the proceeds of any notices issued.
* Powers have also been extended to allow local authority officers to apply for a warrant to seize any equipment which is causing the noise.

your alarm wil be "A" weighted db level which is much louder than a "C" weighted d level, "A" weight is a particular frequency point source noise and "C" is a entire frequency coverage and uses a longer time delay therfore reading more noise... pigs at feeding time create 125dbC and 99dbA ish.. pigs as an example so to hear 77dbC in your livingroom may actually be no louder than talking level...in some cases.

Threshold of hearing 0 Don’t hear anything
Broadcast studio interior or rustling leaves 10 1/32nd as loud as conversation
Quiet house interior or rural nighttime 20db 1/16th as loud

Quiet rural area or small theater 40db 1/4th as loud
Quiet suburban area or dishwasher in next room 50db 1/2 as loud
Office interior or ordinary conversation 60db Ordinary Conversation
Vacuum cleaner at 10 ft. 70db Twice as loud
Passing car at 10 ft. or garbage disposal at 3 ft 80db 4 times as loud
Passing bus or truck at 10 ft. or food blender at 3 ft. 90db 8 times as loud
Passing subway train at 10 ft. or gas lawn mower at 3 ft. 100db 16 times as loud
Night club with band playing 110db 32 times as loud
Threshold of pain 120db 64 times as loud as conversation (twice as loud as night club)

ALL "A" weighted....
